If your community is teetering on destruction because of a glass pipe, chances are allowing or not allowing sales of said "glass pipes" isn't going to make the difference.

No one has addressed the REAL reason this is happening.
The fact is that the marijuana biz eats away at the Satanic monopoly that the medical doctors have created in Florida with their cash only no questions asked pain pill prescription over the counter system and the tax REVENUE it creates.

I've seen people in my state go from herb to pills because it's more convenient and legal.
And I have never EVER seen anyone who went into this abyss of prescription pain pill addiction come out again.

Sure, FL has made a lame move in the wrong direction by even suggesting such an ignorant piece of legislation, but for you to continue to demonize conservative people, and try to make them out as if this whole problem is due to "more insanity from the conservatives" as you so eloquently put it, is pretty irresponsible journalism, IMO.

An act relating to retail sales of smoking pipes and 2 smoking devices; creating s. 569.0073, F.S.; prohibiting 3 retail sales of certain smoking pipes and smoking devices 4 under certain circumstances; specifying criteria for the 5 lawful sales of such items; providing a criminal penalty 6 for unlawful sales of such items; providing an effective 7 date. 8

Be It Enacted by the Legislature of the State of Florida: 10

Section 1. Section 569.0073, Florida Statutes, is created 12 to read: 13
569.0073 Special provisions; smoking pipes and smoking 14 devices.- 15
(1) It is unlawful for any person to offer for sale at 16 retail any of the items listed in subsection (2) unless such 17 person: 18
(a) Has a retail tobacco products dealer permit under s. 19 569.003. The provisions of this chapter apply to any person that 20 offers for retail sale any of the items listed in subsection 21 (2). 22
(b) Derives at least 75 percent of its annual gross 23 revenues from the retail sale of cigarettes, cigars, and other 24 tobacco products. 25
(c) Derives no more than 25 percent of its annual gross 26 revenues from the retail sale of the items listed in subsection 27 (2). 28

(2) The following smoking pipes and smoking devices are 29 subject to the provisions of this section: 30
(a) Metal, wooden, acrylic, glass, stone, plastic, or 31 ceramic smoking pipes, with or without screens, permanent 32 screens, or punctured metal bowls. 33
(b) Water pipes. 34
(c) Carburetion tubes and devices. 35
(d) Chamber pipes. 36
(e) Carburetor pipes. 37
(f) Electric pipes. 38
(g) Air-driven pipes. 39
(h) Chillums. 40
(i) Bongs. 41
(j) Ice pipes or chillers. 42
(3) Any person who violates this section commits a 43 misdemeanor of the first degree, punishable as provided in s. 44 775.082 or s. 775.083. 45
Section 2. This act shall take effect July 1, 2010. 46
