Walmart fires Michigan man for using medical marijuana!!

BATTLE CREEK, Mich. (WZZM) - Now that medical marijuana is legal in Michigan, can an employer fire a worker who tests positive for the drug?
WalMart says it can, so it did. "I was terminated because I failed a drug screening," says former WalMart employee Joseph Casias.
In 2008, Casias was the Associate Of The Year at the WalMart store in Battle Creek, despite suffering from sinus cancer and an inoperable brain tumor.
At his doctor's recommendation, Casias says he legally uses medical marijuana to ease his pain.
"It helps tremendously," he says. "I only use it to stop the pain. To make me feel more comfortable and active as a person."
During his five years at WalMart, Casias says he went to work every day, determined to be the best.
"I gave them everything," he says. "110 percent every day. Anything they asked me to do I did. More than they asked me to do. 12 to 14 hours a day."
But last November, Casias sprained his knee at work. Marijuana was detected in his system during the routine drug screening that follows all workplace injuries. Casias showed WalMart managers his state medical marijuana card, but he was fired anyway.
"I was told they do not accept or honor my medical marijuana card," says Casias.
In an e-mail from headquarters, WalMart spokesman Greg Rossiter explained the company policy. It states: "In states, such as Michigan, where prescriptions for marijuana can be obtained, an employer can still enforce a policy that requires termination of employment following a positive drug screen. We believe our policy complies with the law and we support decisions based on the policy."
Casias says he never used marijuana before work.
"No, I never came to work under the influence, never," he says. "I don't think it's fair. Because I have a medical condition I can't work and provide for my family?"
Casias has been collecting unemployment compensation since he was fired in November but this week he says he was notified WalMart is challenging his eligibility for benefits.
"It's not fair," he says.

This is one sad assed story.. I got up this morning and thought I would make a run to Wal-Mart and I remembered this story. I cant bring myself to walk through their doors again..

I shop at Meijer and my local grocery store. Wal Mart is the devil for many reasons. They exemplify every flaw in a capitalist system. Im not against capitalism or democracy, at all, but Wal Mart exploits the system and shows us what can go wrong when a company gets too big and powerful. I have boycotted Wal Fart for almost 5 years now and havent noticed a change in my budget at all. They suck!

Last year Wal-Mart bought the LARGEST manufacturer in china and with in 6 months used it to buy up the remaining 4 that were worth owning. So in effect if you shop at Meier,Dollar Stores,or anywhere else for that matter good ole Wally is still making bank.

Wal-Mart in the US has grown to United Way status. In other words they can pretty much do what they want simply because without them Our government could not handle their loss.

Wally owns the manufacturing and distribution the United Way ends up using 9-12% of ALL donated dollars for the actual cause (the rest is operating expense).

It's damn hard to beat someone at their own game when THEY control the pieces.

A fine example is why the Coyote only caught the Road Runner 3 times. Each piece of equipment the coyote used to catch the road runner came from where.? Acme Inc. right? Well Acme Inc. is a subsidiary of Road Runner Inc.

Yes i agree people should boycott all walmarts. They are one of many corporations raping the planet and getting away with it and the poor shlubs like the rest of us have to suffer due to the fact they sort of control the goods. But boycotts due help the common folk if we band together and show these businesses that our money speaks and it speaks loudly. if i were this individual i would begin proceedings for a lawsuit on medical necessity as well as discrimination of the highest order. This is not right and Walmart needs to see the light at the end of the tunnel.

What people fail to realize is that Walmart is NO DIFFERENT THAN ANY OTHER COMPANY. I have yet to see a state pass a medical marijuana bill that prevents employers from discriminating when their employee uses marijuana even with a legit medical condition and doctor recommendation.

I'm in Cali, and I have a script, but I still carry fake piss with me at work all the time just in case. It has been proven in court (at least in CA) that prop 215 and sb420 DO NOTHING TO PREVENT YOU FROM BEING FIRED IF YOU FAIL A DRUG TEST!!!!!

To boycott Walmart for this reason means you have to boycott every large company. Small mom and pop business may act more compassionate, however you really need to realize why these companies often take this stance. Because medical marijuana is barely legally recognized, no insurance company will back it. This creates the the situation that we are in: you can 'legally' use it, just don't get caught at work.

Now, there are good reasons to boycott Walmart besides this issue. Examples include but are not limited to: stiffing employee's so they aren't full time and thus don't receive benefits, shady business practices with requiring manufacturers to drop their already low prices (slave labor wages in China), and other shady local business practices where they open stores. But their stance on marijuana should not be one.

What we really need is a federal law that trumps all state laws and allows medical use without any repercussions--just as there is when someone gets a script for pills. Or at least we need to change the laws in the states that have medical marijuana to protect employees from their employer when they fail a drug test.
