Seattle: No Prosecutions for large Collective Grows

King County Prosecutor Dan Satterberg has said his office will not file criminal charges against a former Seattle man who had more plants at his collective medical-marijuana grow than allowed under state law. According to Mr. Satterberg, this kind of case is becoming common, and he has refused to bring charges against most collective grows since the law is unclear about their legality.

Washington state allows individuals to grow up to 15 plants, but doesn't state whether collective grows are so restricted. Mr. Satterberg says he will consider each case individually.

"I don't want to prosecute sick people," Satterberg said. "If this is a legitimate medicine we should treat it like a legitimate medicine. It seems that if patients want to band together and share their time and authorizations they should be allowed to do that."
That is an amazing statement coming from a prosecutor...

Sadly the news story has another spin. He was narc'ed by the electric company.
On Jan. 15, Shoreline police showed up at the home after being notified by a Seattle City Light power inspector that he may be running an illegal drug house, Hiatt said. Spohn, 48, told investigators that he was growing medical marijuana and had 85 plants inside the house, said King County sheriff's spokesman Sgt. John Urquhart.

Seattle is definitely more progressive than a lot of other cities in WA with regard to respect for and handling of MMJ laws. For example, marijuana is a "lowest enforcement priority" for the city of Seattle, but the city I live in (North of Seattle) they jump at the chance to arrest and prosecute any marijuana user :(

You certainly wouldn't get away with a collective grow here. The cops seem fairly willing to leave a provider/caretaker alone here if they are in compliance, but only if they are growing for one person only. They don't consider collectives to be "in compliance".

let go BALLS OUT Washington! Im growing all i can and recruiting all i can... dispensaries should be legal too. my group is producing a ton, and its never enuff! i think we need to put more people in olympia.

I'd rather not say, though I would like to point out that the Cannabis Defense Coalition website has an online calendar where you can see which MMJ-related court cases are happening and where.

If you want to know how often people with valid doctor recommendations for MMJ are arrested and prosecuted in WA State, that's a good website to check out.
