Who refused a search, or turned down a Knock & Talk? share!

We always hear about people getting busted because they readily consented to a search, or in some way complied with LEO when they didn't have to. But what about all the people who don't consent to a search? Who don't allow cops in their homes, etc?

I don't have any stories to share myself, but I'm interested in hearing them, and they will probably be useful to us all.

I have refused to let them search. They did get a warrant and they did find some evidence but not enough to arrest me. How do you turn down a knock & talk? It isn't like they call first to schedule it. "Sorry to bother you at 3 am but at 4 we're sending over a detective to Knock on your door to Talk about some illegal activity that may or may not be taking place at your home/place of business"

walking out and quickly shutting the door behind you so they don't step inside, and reminding them that without a warrant you have the right to refuse a search.

They knocked and you spoke with them. How is that refusing a knock and talk? Yes! You denied them entrance. But yet they Knocked and you Talked. I would have guessed that someone asking a serious question would want their inquest taken seriously and literally. Are you wasting my time here? I would have guessed that you had some questions about the Request for Permission to Search, the warrant (how long did it take to get 1, did I have a chance to hide or destroy anything etc) and subsequent search.

Was smokin and playin video games with a friend when LEO knocks at the door while we're puffing. I've got 3 plants in full flower with no scrubber. Meanwhile, my friend is saying DUDE you HAVE TO ANSWER IT. I just told him flat out shut the fuck up and don't move. He went as far as almost exiting the room to answer the door himself that fuck. Good thing I don't mess around.
I don't answer my door unless I expect company
He knocked for about 15 minutes and waved his flashlight though the blinds and ended up leaving his card on the door
I called him back and he was just looking for my landlord to pay his back mortgage.
Scared the shit outta me..

I had the popo knock on my door once and I did not answer the door. Whatever they wanted I doubt that it had anything to do with my grow. I'm legal now so wouldn't worry about it too much but I never answer my door if I look out and see someone I don't know.

happened to me a few months back also.freaked me the hell out.they knocked,i answered,went outside and they informed me that heard blah blah bla,can we take a look? i told them to show me a warrant and they could do what was within there rights and they left looking dumb.i shut down immediately.they have yet to return with a warrant.i now do my thing elsewhere. i thought i was screwed but it turns out it is happening all over the great sunshine state

In the early 90s I lived in a Midwestern state & had 4 plants in flower in the basement. I hear a knock on the door, look out & there is a cop. I ran down to the basement, slammed the plants into a large cooler, placed the light in a cardboard box & then went out the back door. I walked around to the front with hedge trimmers in my hand so I could act like I had been doing yard work & had not heard the knock.

By this time, the cop is near his car, which was parked across the street. He saw me and walked back over. I was trying not to look nervous as he said, "Sir, your neighbor across the street is an elderly widow who is getting really upset about people ringing the doorbell and running. Have you noticed any kids around who could be bothering her?" I tried not to laugh & promised the cop I would keep an eye out.

I went back inside & I had snapped one plant in half putting it in the cooler. The other three were OK. So I did not really have a knock & talk, but it scared me to death anyway.

I refused a search of my vehicle while being ticketed for traffic violation, have multiple possessions on my record but I made it extremely clear about 3 times that I would not consent to a search, and they told me to have a nice day and did not search.

And I NEVER answer my door unless you call first.

I've refused 2 searches in my life, one after a vehicle stop, and the other an attempt to gain entry to my home. In both cases the cops went away and nothing came of it. The vehicle stop was easy the cop basically said 'oh, ok' and 'have a nice day sir'. The attempted home invasion was heinously drawn out, with the cop finally pounding on the door of my empty home trying to get someone else to open it and give him permission to search after he realized I was just going to stand there and not talk to him.

I also knew a girl back in the day who was the person to go to for whatever drug you needed, and she lived in a house that partied day and night. The cops inevitably got a search warrant because of her lifestyle. For some reason when they served it, rather than identify themselves as police they decided to knock on the door and say 'gas company, we have a leak and need to come inside'. One of the roommates opened the door, but my smart friend quickly screamed one word "NO" and attempted to close the door but they pushed their way in. She won the suppression hearing because she said that one word., and these cops had a friggin' search warrant. But the gas company has no right to force entry, even if there were a leak. It was never explained why those cops fancied themselves gas leak repairmen that evening, or why the idiots didn't bother to make sure the house was actually connected to the gas main.

Just say no. It doesn't work in every case, maybe not even in the majority, but giving permission to search guarantees your conviction, in every instance. Your choice is having a chance to walk, or no chance. There's no need to be impolite in the matter. Repeat the meaningless phrase 'with all due respect...', the very meaningful phrases 'I have an expectation of privacy', and 'I can't speak to that sir' when asked why you won't consent. All statements in the most polite voice you can muster, and dig down deep and make it real. Then finally if the issue is pressed the correct closing phrase is 'I'm standing mute', but only once and then do just that, stand mute. Mute means shut the fuck up.

Got pulled over driving north on 95 in Indian River County by the Sheriff Drug Interdiction team on a sunday around 9am on my way to go surfing with a friend, had a quarter in the car and a bowl, cop pulled me over for legitimate reasons (going 95), he gave me the typical speech about how this is a major drug corridor, I pretended to be interested, all my info checked out, no priors, he then asks if he can search the vehicle to which I give a firm but polite no (because I wanted to make it to the beach for low tide), he asks me to step out of the vehicle, I roll up my window and separate the mechanical portion of my key from the remote and left it in the car and proceeded to lock the doors with the remote when I stepped out, He said if I didn't let him search they were getting the k-9, then I overheard the sweetest words ever uttered on the police radio (thats a negative on the k-9 for IRCS ##). from then I knew it was just a matter of a few more minutes before I'd be sent on my way with my speeding ticket.

FUCK THE POLICE know your rights

the way I figure you can play the game, stand your ground and potentially get away, or you can fess up and tell them everything and certainly catch a case

personally when the cops dicided to make a drop by my house the first week i moved in i was moer than shocked i was down right scared but all i had to do was go out side and talk to them about who i was when i moved in who owened it all that bull but soon i reallized that they ithere dont have enuf evedence of a grow house in full production or they were there for diffrent reasons ether way they cant enter your house unless they have a warrent (unless u live in surry bc canada where they are allawed to come in to the house with out a warent if you have a sespected grow op. )

Another thing to keep in mind is that ANYTHING illegal in plain view is grounds for immediate entry and "probable cause" since they have a duty to seize anything in plain sight, and then once they are in you are screwed because you will be arrested and they will search your house as a result of your arrest. No roaches in ashtray near front door or windows, no bongs, no pipes, no bags of weed, no nothing. Put it all away. When you leave your house to go out anywhere there should be nothing illegal visible whatsoever. Keep it in a designated safe area like a drawer or cabinet that closes so it is not visible from any vantage point. Failure to heed this warning will end up with you being in jail one day, it's a main reason why many people are busted. When I used to live in NJ I had a knock & talk and refused entry for about 20 minutes while being badgered to do so at my front door, the cops behind the main guy kept saying to look for anything in plain view, did he see any rolling papers, pipes, etc. so had there been a pack of zig-zags on my counter with a bag of weed or a glass pipe or similiar that day I would have been bent over for sure. Luckily I am legal now and don't worry about shit like that but after so many years of being paranoid it's hard to not worry anyways still. So for all you out there who are not medical you better make sure to put it away out of plain site! Also, you do not have to answer the door at all. If they are knocking it is because they cannot just come in without your permission = no warrant. Talk to them through the window and tell them you are not willing to consent and to have a nice day with no hard feelings, it's not because you have anything to hide but because you value your privacy and the Constitution of the United States of America. They will of course tell you they are coming back with a warrant to get you to comply and will say things like "just let us in and we will make it easy on you and help you out" ...at which point you can tell them that getting a warrant will be a complete waste of their time and resources because you are a law abiding citizen with nothing whatsoever to hide. I would also tell them they are being recorded and you are requesting they leave your property. :joint:

I had a pretty bad situation relating to this happen back when I was 18. The judges daughter in the town I live at, got caught smoking pot and hated my roomate. She said that she got the pot from him to her dad. So, one day after just smoking a joint with a good amount of reefer sitting out I hear a knock at the front door. It is an older gentlemen in a sports jersey and a woman. I figure its probably just a neighbor, so I open the door. At this point he reaches inside his shirt and pulls out a badge. "__________ Police, we need to speak with you, can we come in?" Remembering reading threads like this with good advice, the first thing I did when he revealed himself as a police officer was step outside and close the door behind me. I also let him know right off the bat that I was 'just leaving' to go meet w/ my parents for dinner. Once I'm outside I see 6-8 un-uniformed law officials wearing ID tags on them (DEA?), and another squad car pulls up, with 2 more police getting out. I figure I'm fucked at this point but keep repeating my rights. Basically he wanted to come in, when I asked him if he had a search warrant he said no but he could go get one. Then he asks me if I had been anywhere recently, which i found rather odd but i answered truthfully. NO, I hadn't been anywhere. After this question the main cop keeps on pestering me trying to get me to let them in. "If you let us in now, you wont get in any trouble..." I was debating letting him in too because i could not get rid of them.

I once again said NO, and then started to walk away when the cop grabs me and says your not going anywhere. You either let us inside, or we're taking you to jail. By this time I'm pissed. I was like okay then, take me to jail. So he handcuffs me and puts me in the back of the squad car where we sit for awhile. On the way there infront of all the other police/law officials standing around my yard, I kept saying really loud and politely, "Why are you detaining me against my will?"

So anyways I'm sitting in the back of the cop car figuring I'm going to jail, but wondering what the charges were. The cop opens the door and talks to me, he tells me the charge they had was me 'Lying to a Police Officer.' I said WHAT?!?! What did I lie about?? He was like... you said you hadn't been anywhere recently, but we found a BURGER KING bag in your trash. I shit you not. He said that. I was like officer, go feel the hood of my car, its dead cold (it was summertime, but the car hadn't been running). He is like no I don't need to feel that. By this time I'm laughing. Because I figure with the way this dudes violating my rights I'm gonna have a field day when we go to court.

Anyways, the cop ends up letting me go w/o taking me to jail. I take down his info and call the police station to file an internal affairs complaint. Now, at this time I was on probation for a pot charge a couple years back. I figured my probation officer would have talked to me about this incident, but the next time I had a meeting, she let me off probation quicker than greased lightening.

I guess they realized the fucked with the wrong kid. Point for everyone... know your rights, don't ever waive them. Make sure other people are witness to your rights being violated, and your total cooperation.

Years ago my ex girlfriend was driving my car and were we pulled over on an interstate by a state trooper. I had quit smoking weed for a few months but had a jar of some excellent hash plant and a few thousand $.
So she pulls over too fast and he had to pull over in front of us. He was pissed, because it's dangerous for a cop to end up in front of the car he pulls over so he comes over yelling at my ex very aggresivly. She starts crying, he feels bad an gives us warning for speeding. Then asks me to step out of the car as I was being very defensive of my girl and used to be a wise ass to cops back in the day. I get the usual do you have any drugs or weapons? Answer with no. We switch drivers and as I'm getting back into the car he goes, what would you say if I said I had a reason to believe there were drugs in the car.
I go"I would say that's not possible".
Then he claims there is shake, stems and seeds in this change collector on the right side of the drivers seat. I tell him he's wrong and proceed to show him he's talking about potato chip crumbs, dirt, sand, pine needles and lint and maybe some tiny bits of old stale cigarette tobacco.
The truth is I had quit weed, alcohol and tobacco for a few months and had recently cleaned the car, he was compleatly full of shit. He says can I have your permission to search the car. I say no. He says why not, what are you hiding?
I take out my wallet, take out my lawyers card and hand it to him. The back of the card states all of my amendment right in that situation. I will admit my hands were shaking a bit, but I was young. My lawyer was a big shot family connection and if you googled his name you would see connections to him and Hoover, mafia hit men ,high profile murder cases and the biggest marijuana and cocaine busts in the history of my home state.
So handing him the card really pisses him off and he claimes he has probable cause to search. I explain he does not and he tells me he'll call in a K9 unit unless I give in.
My girl is freakin out at this point and I know he cant make anything stick. I keep asking him not to call the K9 and explaining his probable cause is based on a compleate lie. He then decides he has probable cause and forces his way into the car and starts searching. I finally say ok,ok I have a small amount of personal weed that I don't even smoke. I tell him the story of why I quit which is personal and told him the weed was just for friends to enjoy which was the truth.
He's looking in my bags and still can't find it, so I point it out and give him the jar. He opens it smells and flinches like just took a shot of bad whiskey. I keep thinking if he puts it on the roof I'm done if he puts it anywhere not visable to passing traffic I'm cool. He asks if there's anything else he should no about and I say no. Then my girl whispers something in my ear. Shit. Officer I was just made aware there may be another small bag of marijuana. He again reaches in my bag and pulls out a bag of shrooms!?
Shit. Then another bag of weed. He asks again anything else? My girl again whispers in my ear. Shit! No! Ok, Ok, I've just leaned there is some paraphernalia in the bag as well. He finds my fav pipe I use to call my green bowl eventhough it was not green. Then another bag of shrooms and two more small bags of weed. I just have my face in my hands. I say,"officer please don't arrest my girl all that stuff is mine please don't put her in hand cuffs. Take me.
He takes all the bags and the pipe, puts them all in the jar and puts the jar on the floor of his cruiser. Yes. Pops my trunk finds nothing. Says just wanted to make sure we weren't running drugs and told us to get the fuck out of there. No drug charges to this day. He never found the 2 gs, thank god. Crazy. That's nothing though compared to real nail biteing situations. Simple possession at worst. I have had friends and aquaintences over the years who've ended up in situations too fucked to speak of here. I've spend my whole life living in fear of prosecution/persecution and in my life time I vow to be a difference maker now that I have the chance.
