random drug testing after employment, can they fire you?

If you get hired after passing a pre employment test, and they retest you during your employment, and you test positive, can they legally fire you?

My understanding is they can't, that they can only send you to a rehab school, maybe out of pocket, but that they can't fire you,because technically it's a disease, and therefore protected, addiction i mean...

is that true?????
 
Hmmmmm.... I don't know if that one will hold up in court.

Technically. TECHNICALLY, they can't fire you (unless it was in writing before you were hired) but they may place you on suspension depending on how anal management is. Right now we are in a recession so if they wanted to let you go, there would be 4,000 people in line to take your job. Regardless of what you do for a living.

I'm not 100% they will not fire you (I'm pretty sure they'll show lenience since your an employee) but I seriously doubt they'll send you to Rehab, especially on their own coin.

But I like the "disease" part. It's not a disease brother!

For sure, seen 100 people get fired for failing.
That being said tho, i failed for weed after a injury accident and they decided to keep me

that's why they're testing after employment...they're looking to fire violations

according to a webpost, they take a sample of your spit
the results don't look good
According to a former girlfriend who worked for Marriott, they test for all illegal drugs (marijuana, cocaine, heroin, etc.) as well as diuretics. Her comment to would-be employees was "if you're using they'll catch it".

There is no incentive to keep you. That's 3 months with a position unfilled/temporarily filled waiting for you to get out of rehab, but that's neither here nor there...

I used to work with Marriot. They are corporate rule-sticklers. Yes, they will fire you if you piss dirty.

Of course they can terminate you for a dirty urine,I'm sure its somewhere in their company rules and regs

I'm not sure, but if they really wanted to fire you, they would find a way lol... gotta love loopholes....

If you get hurt on the job.

A DT is the first thing you are getting. Anything shows up, no worker's comp.

I would think if your performance is suffering, and they administered a DT, you would be fired if it came back positive.

Where I work they can only drug test you with reasonable suspicion, such as post accident, or clearly coming to work intoxicated.

Hey, at least there is some good to it.....

If you get hurt and miss work, it won't hurt, to miss work.
