Growing on probation with MMJ

I'm on 5yrs probation for growing,pleaded no contest to a felony with a motion for defereal, meaning if I complete probation without any violations I'll get this removed from my record.

I recently obtained MMJ for legit reasons, My PO at first seemed a lil shocked when I told her I got mmj lol, but after talking to her a lil bit about why I use it, she seems to be okay with it(I think). She asked me If I was growing and Im not so I said no, then she asks well where are you getting your marijuana? theres no dispensaries here. lol my eyes got a lil wide for a second then I said uhmm I have a friend that has mmj and he gifted me some I think it worked tho.

Anyways now that I have a MMJ permit I really wanna grow legally under
the state mmj laws, but im a bit scared. What do you guys think? Can I get in trouble If I fully comply with state mmj laws? Should I ask my PO If I can grow legally?

I am in almost the same place you are. You have to ask yourself if it is worth it.

To be honest it sounds like a really, really bad idea to me. You're just making it easy for them to shaft you. Unless you want to risk prison and/or spending tens of thousands of dollars pleading your "legit MMJ" defense in court, I'd recommend waiting until your probation is over.

I'd also recommend that you read the terms of your probation again and make sure it doesn't specifically stipulate use of MJ as a violation, because I'd bet that being a legit MMJ user does NOT trump the specifics of your probation.

Just sayin' be careful dude, it sounds like you're setting yourself up for problems. Don't count on the MMJ status to protect you, 'cause it probably won't, and even if it did, you'd still have to spend a truckload of money on lawyers to validate it in court.

But I'm not a legal expert or anything, this is just my gut feeling on the subject.

What state are you in? If you're in Cali you're golden.

ask your PO. Sounds like she might be open to the question. She may say no, but if she is already okay with you smoking because of your med status you never know - she might be okay with growing. Really sucks that you are in legal trouble for something you can legally do now. But in my eyes, if your mmj allows you to grow, then it shouldn't be a violation since it isn't breaking a law.

Why Cali? im in hawaii.
Hmm...I think it comes down to my PO's choice right? we've always been on good terms but I might be getting a new PO next year cuz this was supposed to a temp one. What if their oppinons differ? my doc said its basically upto my PO.

I wish the mmj would protect me but im not sure.

Well, you didn't say which state, and odds are that if someone says they're a legal MMJ patient they're in CA. Also, I know the answer for Cali!

Anyway, since you're not in CA what I'm pretty sure I would do were I you would be to find some locals that have dealt with it. Are you anywhere near Patients Out of Time? OK, for all I know they could be assclowns, but they get enough press that I know their name. I'd also be straight up with my PO, and try to keep in mind that there are 73 different ways from Sunday that he can screw me if he disapproves even if he can't touch me for growing under license. So even if he says yes it may be in your better interest for you to decide to skip it. I'd think your illness would also matter. Again, if it were me I'd make sure to take in the x-ray of my spine as I'm one of those people that the police think perfectly healthy when they see me standing in line at the dispensary.

But really, my best advice is to find some locals that have already dealt with the situation.
