I agree, that is worded horribly. Didn't they JUST change that definition recently though? I seem to remember the definition of caregiver being more vague previously.
Well in June they (State Dept. of Health) wanted to limit the number of patients a caregiver can serve to 5, but that did not pass it after the protests from the community. But that's all I know of in that regard.

At that meeting they (CDPHE) didn't get the 5 patient limit passed, but I think they did change the definition of caregiver.

Sound like they intend to make the caregivers keep track of the cardholders, by making check on them one way or another. Adding to their responsibilities; if they don't have monthly contact, they can't supply them meds. Just a thought how they could manipulate the situation. In effect make them take attendance. Very tricky

Of course, the problem is that government in the state of Colorado is incompetent and unable to manage anything. Look at any of the social programs in the state; they have a hell of a time just giving money away! Right now they take 11 weeks to issue a simple MMJ card! How are these morons going to manage any of these new regulations they claim to be preparing to implement?

If you can find any info on that it would be interesting to see what they came up with.

I was wondering if anyone knew how this may affect patients helping other patients. I assume the woman in this case was only a caregiver and not a patient herself?

Do wheat farmers and traditional pharmacists have to provide wellness services? I thought not.

This is really fucked up. Cannabis IS the wellness service, the patient's MMJ card is the wellness "advice". I'm not going to pretend I'm a doctor because IMO THAT is a crime. This is going to lead to lots of bad medical advice from people who aren't trained to give it. Medical advice is the doctor's job.

These rules were changed as of 8-30-09 and the definitions were cleaned up to this.

iii) “Significant responsibility for managing the well-being of a patient” means assisting a patient with daily activities, including but not limited to transportation or housekeeping or meal preparation or shopping or making any necessary arrangement for access to medical care or services or provision of medical marijuana

I believe Attorney Rob Corry has mentioned that this case only applies to cases busted before 8-30-09, that with the new rules as of that date that cg are ok with only supplying MMJ.
DON"T BELIEVE ME ON THAT, ASK YOUR ATTORNEY, TO BE SURE.

I still believe that a cg should at least know your patient , meet and have dialog, weekly contact and help where you can and they need. Does not mean you have to pay for what they need but help get-r-done.

In an underhanded move, the Colorado Board of Health will be voting to weaken the medical marijuana law at an "emergency" meeting on Tuesday, November 3 at 10:30am in Denver. At this stealth meeting the Board will be voting to redefine what a "caregiver" is to require such individuals to provide supplementary-- and often unnecessary-- services beyond simply providing sick patients with medical marijuana.

"This is like requiring my pharmacist to give me a massage or make me a sandwich," said Dan Pope, muscular dystrophy patient and medical card holder. "I can do those activities myself. I need a caregiver to give me medicine. End of story."

This meeting, which was announced in a late afternoon email to a small handful of patient advocates, is another example of the state engaging in underhanded tactics in their effort to undermine the medical marijuana law and the will of the Colorado voters. Please help hold them accountable.

(1) Attend the Meeting. This meeting will occur at 10:30am on Tuesday, November 3 in the Snow Room, 1st Floor Building A of the Colorado Department of Public Health and the Environment, 4300 Cherry Creek Dr. South, Denver CO.

I hear ya SJ...Lets all put our best intentions together for a positive outcome. I will be on the call as Im sure will many others. There we bound to be bumps in the road..but its how we deal with those bumps that furthers our cause.
