Court Slams LAPD For Illegally Seizing Medical Marijuana Profits

In a remarkable opinion issued today with potential Orange County implications, the United States Court of Appeals for the Ninth Circuit blasted the Los Angeles Police Department (LAPD) for committing "highly objectionable," "tainted," "reckless," "misleading" and "illegal" conduct in a 2005 attempt to seize more than $186,400 from a legally compliant Southern California medical marijuana distributorship.

The justices showed no patience for LAPD's efforts to keep the cash for itself and then later--after it was clear they couldn't take possession legally--transferred it to Thomas P. O'Brien's LA-based U.S. Attorney's office, which planned to kickback as much as 80 percent of the money to the local cops.

"We are particularly concerned by the possibility that the LAPD might stand to profit from [its own] unlawful activity," wrote circuit Judge Richard R. Clifton, who went on to describe the money grab as "disturbing" and a "distinct" violation of the U.S. Constitution's limitations of police state activities such as tainted searches and seizures of private property.

The opinion reverses a federal District Court's ruling that blocked a summary judgment motion by United Medical Caregivers Clinic, Inc., which was trying to regain its plundered cash from federal agents. Though California law allows for medical marijuana distributorships, the feds eventually grabbed the clinic's cash under the theory that all marijuana sales are illegal under federal law. LAPD's misconduct should not preclude federal agents (who weren't involved in the case) from taking control of the money, federal prosecutors said.

(Interestingly, in a specious, last-ditch effort to prevent the clinic from recovering its funds, LAPD also argued that they'd conducted the search to protect federal law.)

But arguments by O'Brien's office failed in large part, according to the justices, because LAPD officers lied to gain the initial state judge-approved search warrant by failing to note that the clinic was operating lawfully under state law. In other words, the cops had no probable cause for their search that produced the cash, 209 pounds of marijuana, 21 pounds of hashish and 12 pounds of marijuana oil.

Noting the "strong" self-interest cops have in seizing drug assets for themselves, the justices said, "The integrity of this court is served by our refusal to allow the government to profit from illegal activity by law enforcement when such activity produces incriminating evidence."

In recent months and after this case was filed, U.S. Attorney General Eric Holder announced that federal agents will not prosecute medical marijuana providers in states where the activity is legal.

Can a legal savvy person dumb this down and explain to me what stops a well-funded lawyer from suing the city for theft?

Holy shit batman, that's a great post. Good find coolx! Can't wait til next Tuesday, the first Medical Marijuana case will be heard in federal court (in California) that will allow the medical defense! If not convicted, I hope it will set some precedent, and all our brothers in jail for MMJ will be freed summarily.

Wishful thinking of course, but it paves the way for mass appeals.

:party: Dirty f'ing pigs. Good for LA. I don't know if it will have any sort of immediate impact. Anytime the cops lose in court in the War on Weed is a step in the right direction. Being that it's coming down from the fed's is landmark. A small one, but one nonetheless.

I was wondering what you guys thought on how this applies to the situation with DA cooley.

My bet was that he is operating under the assumption that all mmj sales are illegal but I think that if the federal court ruled that the dispensary in question was compliant with state law then that throws that argument out. So if a dispensary is operating under the provisions of state law then they will be able to fight cooley even in federal court.

Man I've been looking all over to find a link for you, but for some reason now I can't find it. Coulda swore I read it in the westcoastleaf.com paper but couldn't find mention of it there either. It said it was in a california federal court, scheduled for oct 27 2009, I think san bernadino or around there. it had a san in it but wasn't someplace I'd been lol

This case is a joke right?

It's not so much being legally compliant but if you multiply 209 lbs times what a dispensary sells it for after they break it up plus same for the hash and oil then this dipsensary was pulling in WELL over a million and were pretty good at being able to hide 80% and the cops are bitchin about the measly 20% ($180, 000) that they managed to seize??

The cops should be irate that the club hid over a million and is using that money right now in their case against them.

This case is like a twilight zone episode.

Like the guy said in the show Pot City USA, "The criminals really are running the show".

I appreciate it man. I'm going to keep my eyes and ear peeled because this would be totally relevant to my situation. Regardless of what happens, I like the way things are trending and trending hard at that.

Uhhh...if they got the 209 pounds...how could they have sold it already, in order to "Hide" that mil??

Because any biz has an ongoing inventory. If they had 209 on hand then they sold 209 recently and will sell 209 in the near future.

No buisiness or dispensary is an island.

It's not like they got nabbed on opening day.

Well I hope they had a bunch of money hid. Because OUR money is being used to prosecute the case.... if they can defend themselves well enough maybe the government will quit spending OUR money to prosecute something that WE already said is legal.

thier collective just harvested and they wont harvest again for 4 to 6 months. Could be that the cops took all the medicine and now the sick ppl from that collective have nothing. Just as easily as your scenario works BlueDot I think my scenario works just as well, so suddenly no money and no medicine because of some greedy crooked cops.

With all due respect Babba, this was an LA dispensary, not a Norcal one.

I could easily see how this could happen in norcal, especially with an outdoor crop, but in LA the dipensaries don't harvest nothin', they just buy from vendors so these guys were able to procure 209 lbs continuously from mostly indoor grows (which is a highly commendable feat in itself) because i think it's highly unlikely a majority of that 209 was outdoor. LA customers just seem to buy more indoor then outdoor IMO.
