Who will know if I get my card?

Okay let me start off by saying I know having my card does not give me the right to test positive on an employment drug screen.

That being said will having my card raise a red flag and get me tested? I already have a great job and do not want to jeopardize it. If it a makes a difference I work for a small government agency in Cali. I had to go through a background check (so that is already done).

My question is after I get my card do I really go on a "list" somewhere or does the doctor just file me away with the rest of his clients. I seems like it is a medical record and should be kept private. Any advice?

I guess I could get clean then stay clean after I get my card for a month and see what happens. But, if something does happen then no more smoking.

What should I do?

It depends. By "card" do you mean recommendation? If you went to your primary care physician, and used insurance to pay for it, the insurance company may know about it.

Your "card" could be from any place. It could be from a collective, doctors office, dispensary, or through the state. Who knows if they actually follow privacy laws, although they are supposed to.

There are only two counties that issue the state id card anonymously, Santa Cruz and San Francisco, so if you don't live in either of those places your name will definitely be added to a state database. But that info should be private, although police can access it.

One of the good things about the County Card, is you are encrypted into a data base, and only your picture and a number are on the card--
It is designed for security, so if they were to be actually accessing that data base, they would have the Lawsuit from Hell on them--
It is by design...and Law, that it is a secure system--

I am skeptical of the actual existence of the Statewide Data base...that LEO can access--
There are so many Patients, that it would be ridiculous to think they are watching all of us--
They are watching the Movement...but I don't think so much the individuals--:yeahthats

I'd be more worried about this as it's harder to hide then the card info.

I am also curious about this. I was just going to start a thread about it! I will be graduating from college soon and will be looking for employment. I am a little skeptical on having my card, though. I would hate for a future employment prospect to not hire me because of my medical card. One thing I am also looking into is becoming a helicopter pilot so I am not sure if the card would effect that too.. I would really like to get all the facts straight before I go and get my card... Any help is MUCH appreciated!

You can go to a head shop and get a wizzanator or whatever they are called(synthetic piss)... I know quite a few people that have used it and passed.

By "card" I do mean recommendation. I would not do the voluntary state ID. I would just go to one of the doctors offices that specializes in Medical Marijuana and pay cash. I would not use my insurance.

Thank you all for your replies. So the general consensus is that only my doctor and the dispensary I go to will know I have my recommendation and if my employer were to find out I could sue?

Unfortunately being a medical marijuana patient in California still means you face discrimination.

And in terms of the database, there is definitely a master database that police at least have to call to access, so it does exist. Whether or not it is the evil privacy-eating database, I'm not sure, but I bet a hacker could get access to it if they tried hard enough. They hack anything.

There is only a "master database" of the people who have state cards.

This document: http://www.oispp.ca.gov/consumer_privacy/consumer/documents/pdf/cis7english.pdf explains California's personal privacy laws regarding health information. Many doctors include a statement regarding how they secure records in excess of state and federal laws. Mine does this. California has many of the strictest health information privacy laws, probably because of so many famous people living in So Cal.

I would get my recommendation in a different county than I work and live in and only go to dispensaries in that county to help limit the possibility.

Thank you ColBatGuano for the link. Can anyone find one that specifically deals with Medical Marijuana to help ease my mind. I might just call a recommendation office and ask what they do with the records.

It varies by establishment.

My doctor holds it in complete confidentiality. He will only confirm it to a legit dispensary, coop or collective calling for confirmation.

I have heard Medicann is good, but don't use them. We have a private Doc here.

Look in the Yellow Pages...or visit the dispensary reviews on this site.

I think HIPAA rules only apply to providers and insurers who use electronic filing or information transfer. My GP is hard-core about privacy. She doesn't use a public sign-in form, and allows only one patient at the counter at a time. Though not one of those medical cannabis "specialists," she's quite sympathetic towards MMJ.

If you have your card and a valid perscription why should it matter if you test positive...unless your a pilot or in my case a cdl driver. That sucks if its true. As I stated im a CDL driver I was kinda sketched when I got my card, but nothing came of it or atleast I wasnt tested. Because of the patient confidentiality act its all between you and your doc. If you have issues and your med is herb your on the right track, dont buy the lies and intimidation and stay away from pills. Peace

I am fine with it being part of my permanent medical record if it is between my doctor and myself.

Having a recommendation for marijuana is not the same thing as a prescription. Your employer does not have to allow you to use marijuana. The only way to get around testing positive for marijuana is to have a prescription for marinol as that shows up as THC.
