san diego dispensaries being raided today sept. 9 2009

The REAL criminals are the ones conducting the raids. Stealing our taxpayers money conducting raids. When they should be protecting the US Border. Stopping terrorists and other shits. I only know that when they face the Devine Creator and history the raiders and enforcers will be realized as the criminals and plunderers. At least then they will pay for their crimes.

Let's not forget that San Diego is the location for the excellent Showtime program "Weeds".

Too bad they aren't PROMOTING that fact instead of trying to eradicate the "Weeds" in their county.

A big part of San Diego and the Cities between it and Los Angeles are considered the Bible Belt of the West. Ultra conservative full of Hypocrisy with a good load of racism thrown in.
The People in power in these areas are not likely to be voted out of office, these people have loads of money most of it made from financing magic and not worked for.

If you check out how activist have found cracks in Anti marijuana arguments, I believe the Supreme Court heard a case where patients provided cannabis to other patients at no cost other than the cost of the medication making no profit. The patients i believe bypassed all the arguments concerning profiting and making money off of what is considered a controlled substance and the Rico statutes that are in place to prosecute such offenses.

What you are battling is on two fronts one is the fight to be able to treat yourself with medication that you see fit. The other is the people who see dollar signs and could give a shit less about patients. If the majority of the collectives got together and lawyered up they would plug the courts up so much that it would go down in history.

We are like crabs trying to climb out of a barrel grabbing each-other and bringing ourselves down over chump change and the money involved around this plant (weed) when all we have to do is realize that if you were not prosecuted for growing the legal amount you are allowed, cannabis would be available to everyone in need for close to nothing at a superior quality .

More than two dozen people operating marijuana dispensaries were arrested in countywide raids that also shut down 14 storefronts, authorities announced Thursday morning.

District Attorney Bonnie Dumanis said the search warrants served at dispensaries and some homes Wednesday “has nothing to do with legitimate medical marijuana patients or their caregivers.”

She said the 14 storefronts targeted were “so-called medical marijuana businesses that appear to be run by drug dealers.”

Officials declined to give details about the backgrounds of those arrested, but San Diego Police Chief William Lansdowne said some of those in custody have prior drug arrests.

Authorities said they are still tallying the amount of marijuana and money seized in the operation. At least $70,000 of cash was seized and six guns were taken into custody, officials said.

Lansdowne said Wednesday's search and seizures culminated a five-month investigation that started with residents' complaints of the dispensaries.

Neighbors cited noise, vandalism and other crimes associated with storefronts, Dumanis said.

“There are now 60 storefronts operating and doing this under the guise of helping people who are sick,” she said.

In an area of Pacific Beach, for instance, Dumanis said five such dispensaries are within blocks of each other. “It is easier to find marijuana there than to find a Starbucks for a latte,” she said.

Lansdowne said the businesses targeted were chosen based on the number of residents' complaints and the amount of activity happening at the businesses.

According to the state's medical marijuana laws and the Attorney General's guidelines, it is illegal to profit from the sale or distribution of marijuana.

The user has to have a recommendation for medical marijuana by a physician. That person, and or his or her caregiver, need to be verified members of a collective or cooperative in order to be compliant with medical marijuana laws.

For example, authorities said dispensaries that merely require patients to complete a form that designates the business owner as the patient's primary caregiver, then offer marijuana in exchange for “donations” are likely illegal and not compliant with medical marijuana laws.

Lansdowne said some of the businesses in the city advertise they accept donations but they won't give out the product without receiving a “donation.”

Dumanis said patients or their designated caregivers who are lawfully recommended by a physician can cultivate plants on their property for their use.

Deputy District Attorney Steve Walter said 23 people were arrested in San Diego and eight people were arrested in North County. Two men arrested face federal charges.

Walter said he was not sure if the men prosecuted in federal court are in addition to the 31 arrested.

The investigation is still ongoing, he said.

Karen Hewitt, U.S. Attorney for the Southern District of California, said one of the men faces three counts of federal charges including two counts for distributing a controlled substance and one count of manufacturing marijuana plants. He was arrested at the Green Kross Collective on Mission Boulevard near Lido Court in San Diego.

The second man facing federal prosecution was arrested at the Movement in Action store on South Santa Fe Avenue near Alta Calle in Vista.

He faces three counts of distributing a controlled substance, Hewitt said. If convicted of all counts, Hewitt said he faces up to five years in prison.

Hewitt declined to say why the two men face federal charges but noted that it did not have to do with the amount of marijuana or cash seized.

“It has more to do with the overall investigation and other federal investigations that I can't get into,” she said.

Not sure what people don't understand about this?

And where in prop 215 or sb420 is the word "vendor"?

The thing that baffels me is, if a dispensary has the ability to do it correctly by city standards (like the 8 or 9 that are apparantly legal and immune to raids) then why don't they all just do it that way? (<--rhetorical question because most of us know the answer).
That way the patients would be served and isn't that what matters in the end?

The DEA is involved only because they need to be around in case it is determined (at the raid, I'm sure,) that the clubs were violating state and federal law. If this is the case, then they are still bound to investigate it. The DEA is not a rogue agency. They don't just operate outside the direction of the Attorney General.

This is 100% San Diego City/County all the way. I don't know what loophole they found to get around our State Supreme Court's recent position that it is not for a city or county to decide if they wish to abide by Prop 215, et al.

I think San Diego is afraid of becoming Los Angeles, where there are so many clubs that even I thought enough is enough (I lived there until recently.) There is an article on the L.A. Times website today in which they included an interactive Google map of all of the clubs in L.A. County. They are at least as ubiquitous as Starbucks. This is going to blow-up in our faces, I think. L.A. County should shut-down at least 80% of them. Most are shit places anyhow--and shady. Others are really quite nice, with decent prices and good people running them. Even a few others are high-end--a little pricey, but definitely also concerned with quality. Those sorts deserve to continue.

Right on. This is exactly how I felt in Los Angeles. It is literally ridiculous there. Most of the clubs ARE drug dealers, nothing more or less. Until cannabis is finally legal and we're all free, we need to keep it down, don't ya think?
