Do I need a Lawyer for A collective garden????

they want 5,000 to start a CA non profit corp and say that is the only legal way of sharing garden space in California. Is this true? I don't have $5,000 for a retainer.:joint::joint::joint:

No.... for several hundred dollars you can set up a Collective of patients through the AG office (Edit: That's Agricultural... not Attorney General. You're setting up a Farmers Collective here). Search around as there are plenty of places that have the info you need. Less than $500 to set up.

Now, if you want to set up a storefront and such.... then you're looking at some bucks as that's a completely different beast.

yeah def not a storefront. AG of CA??? I'm in LA County and they have a moratorium on Dispensaries.

If you can help with links for the AG collective of Patients i would appreciate. I'm searching..

the AG guidelines recommend structuring as a non profit business. as far as i can tell the LAW states i can have a collective garden like a community garden. i don't want to start a business or incorporate. seems crazy that a patient would have to start a business to secure meds. can't be constitutional.

do i need to start a pharmaceutical company to get the poisonous pharmy's my other docs recommend? WTF?

if you have any links please help :)

No offense, but if I was starting something of this nature I would defiantly want a lawyer on my side. Have you tried contacting more than one or did they all want 5 grand? Plant numbers can start to balloon pretty quick with that type of thing and while I doubt the feds would bother you unless you got huge, it wouldn't hurt to be ready if they came knocking.

yeah they all want a $5,000 retainer to file Non Profit Co-Op. i just know a few patients and we would be well below any federal mandatory minimums.

Seems crazy you have to start a company to have a garden. THere are many community gardens across America and those people don't start businesses.

CHeck out canorml.org for info on collectives, very very little documentation (which is good, fewer rules to break/bend or misinterpret.) As I understand it a collective is as simple as a handful of patients gardening together, and the grower is often compensated up front for his time/space/power in exchange for the finished meds.

THanks Lazyman!!! i will reread what cannorml says. i think thats the best info so far.

I think all of these lawyers just want their cut of the market. They figure anyone going into this is a gangster.

The real gangsters are charging $70 for a "compassionate" 1/8th. I'd rather grow my own but can't afford the space myself.

The price for the paperwork is less than $500, yeah I'd say a $5K fee is a bit much. Again, as long as it isn't a storefront and is strictly a patients between patients, make sure you have your bylaws and such setup and go for it.

Seems like not much of a co op if you have problems, for one it is not good ripping off the tax.

It seems that everyone wants to be rich and famous, that is not a good spot light! It's not bad if you care deeply about human behaviors, it's a bit sickening. I know we all want some nice plants and not everyone let's the little gnomes in to heal or make shoes~

It's a bit like that, people want people with skill! Everyone is tired, it's hard to devote ourselves.

I hope you find some land and treat it kindly and that the vermin do the same!

I don't think that God hates all gays and all cannabis users, it seems a bit rude about healing!

Not everyone knows how they got to this point in life, or the next!

Sadly to many do not want to know, in this life~

Have all members of the collective sign a Medical Marijuana Collective Agreement. There are many examples of these on the internet. Have these signed agreements available at the grow site.

Copy and post at the grow site the doc rec's (and I recommend state cards as well) of all members.

Copy and post at the grow site the following: County MMJ guidelines from which you reside, CA AG Guidelines of Aug 08, Prop 215, SB 420, HS codes.

Prepare a binder containing all of the above for when you travel with meds.

Post at the grow site notices that your grow is a legal MMJ cultivation compliant with all applicable state and local laws, codes, and ordinances.

this idea seems the most legit. with all of this [while making sure the county limits are honored] i bet you could get yourself off in court if you had too!......

or could you??!?! (serious question anyone with knowledge plz answer!)
