10:30am -- State To Review Medical Marijuana Criteria Permalink comment E-mail

Hearing in ABQ on Jan. 15 to consider adding other illnesses to list of eligible medical conditions.

The New Mexico Department of Health's Medical Advisory Board will hold a public hearing Jan. 15 to review petitions for adding new health conditions to the list of conditions for which patients may receive medical marijuana for relief, The Taos News reported.

The hearing will begin at 9 a.m. at Los Griegos Community Center, 1231 Candelaria NW, in Albuquerque, and the board's eight board-certified physicians will review petitions already submitted to the health department and make recommendations to Health Secretary Alfredo Vigil, who will make the final decision, the News said.

Petitions already have been submitted to the health department asking to add such medical conditions as Crohn's disease, chronic pain, post traumatic stress disorder, hepatitis C, bipolar disorder, arthritis and sciatica, astham and chronic obstructive pulmonary disease, peripheral neuropathy and anorexia to the list, according to the News and a health department news release.

Current qualifying conditions to receive medical marijuana include cancer, glaucoma, multiple sclerosis, damage to the nervous tissue of the spinal cord with intractable spasticity, epilepsy and HIV/AIDS, and hospice patients may be eligible, the release said.

Since the program began in July 2007, the Department of Health has approved 206 patient applications, according to the release.

To qualify for medical marijuana, a patient's medical provider must certify that the patient has one of the eligible conditions, that the condition is debilitating and that the benefit of medical marijuana outweighs potential risks, the health department said.

To apply for the program or to petition the department to include a new condition, go to www.nmhealth.org/marijuana.html or call the Medical Cannabis Program Coordinator at (505) 827-2321.

The Medical Advisory Board will meet again in March to review additional petitions, the release said.

thats awesome. its moving along quite nicely. wasn't sure how long it would be before the laws got past the terminal illnesses and started targeting other debilitating non-lethal illnesses as well. sounds like need to get a few friends together and head up to that hearing. thanks for the heads up!

That's great news! I hope all of you patients in NM attend.

I feel that all MMJ laws should have had/should have a clause that requires the state to review for new conditions every 2 years minimum. It seems like in most states it's nearly impossible to get additional conditions added.

in new mexico the process has been kinda different from the other states. for starters, the state is going to be growing/dispensing the medication, as to protect the patients and caregivers. there isn't any medication being issued right now as they're still trying to work everything out with the laws and dispensary locations etc. which is why this hearing is probably going on. once the dispensaries are in full service and the state has the program fully running, i'm sure it will be much more difficult to get new illnesses added to the list. when it started in NM, there were merely 200 eligible patients. this was in '06. now as the program has developed there are upwards of several thousand patients and after this hearing there may be closer to 10,000 eligible patients. hopefully that list of additional illnesses does get added as i have several family members including myself that have been using mj for medicinal purposes for years in the fear we will be spending time in jail for choosing the medication that best works for us without making us feel like a zombie or risking becoming severely addicted to opiates. its been a long time comin, better watch out cali, the sun out here grows some mean weed
:rasta: as for a law that requires the state to review applicable medical conditions every two years seems like a great idea. i might bring that up at the hearing. good way of keeping checks and balances on what MM can treat.

ha what about us southerners in the lower half of the state? am I just supposed to walk my happy ass up to 'burque? What's the deal with specified conditions anyway? Call me old fashioned, but cannabis should be available to anyone with the advice and consultation of a doctor/caregiver/whathaveya, you know, folks with medical experience. I'm just gonna keep doin' my thing and let whoever wants to kick down my door do their thing, man.

don't you worry, there's plenty of us up here in the mid-nm area to cover all you guys down south. and that's the point of the hearing and the list of applicable conditions. if there weren't some statutes and limitations as to who specifically qualifies, anyone could get it. that seemed to be a pretty big hurdle for prop 215 in cali.

Word brother, and I sincerely thank ye for representin'. I wouldn't be so down on the limit of conditions, because it's great for the truly deserving, but to me medical marijuana has always seemed to be the foot-in-the-door to full out decrim/legalization and it would make sense the more lax the med rules the better it is for everyone.

Though I'm very happy that NM has a medical cannabis law at all, I'm very unhappy that the whole thing is state run. Part of many patients therapy is growing and caring for their own medicine, and it sounds like the system in NM takes that away from them. Sure glad I live in a state where I can grow my own! The last thing I want is government issued schwag.

the smart people are in charge now (dems). bill richardson has done an incredible job in nm. it will happen, you just have to start slow and be patient. never just ram it in!

One thing I wonder about MMJ in New Mexico is how to travel with all the check points that are in the south and the surprise ones that pop up from time to time. I dont think that the Border Patrol would adhere to state law considering they are a federal agency.

Anyone know?

Boarder patrol IS federal

Boarder patrol IS federal

You'll at the least lose your meds, at worst, you'll be taken into custody. That's assuming the dogs are out and they find your stash.

I travel thru checkpoints on a regular basis and never get more then a passing glace, even when my trunk is full of frozen meat and groceries.

Now why we have a boarder patrol checkpoint over a hundred miles from the mexican baorder is another question....
