Getting Off Drug Court!

Well as some of you know, I was busted back in march with a small ammount of very potent ganja and about 17 hydrocodones (was a bit addicted to opiates back than). I made the mistake of paying the first lawyer I met and she turned out to be horrible, way to young and naive to help me out with my case which the local drug task force was involved with.

Worst $1000 I ever spent, at the time I was selling small ammounts of marijuana (idiot) and somebody narced me out and set me up and made a buy where the drug task force was waiting nearby to make a traffic stop on me and search me illegaly. They thought they were taking down a big timer or hopefully I would rat somebody out for them, but they were dead wrong.

Anyways, I was charged with a Class A misdemeanor for possesion of a controlled substance (max 1 year jail and/or $1000 fine) and a citation for unlawful possesion of marijuana (max $100 fine in my state, no jail), with no prior record at ALL, and no intent to sell or distribution charges because they had no evidence and couldn't get me to admit to it when I was brought in by them. I was released on my own recognizance.

My lawyer really screwed me over. She couldn't get the DA to lessen or drop any of my charges and the best plea bargain I could get was 3 years of probation or 1 year of drug court with 6 months of ACD and my record would be erased upon completion. She told me drug court was easy and no big deal, all I had to do was check in once a week and be on my way. Boy was she wrong, theres random drug tests (about 3-4 a week), mandatory self-help meetings (NA, AA, ect), mandatory outpatient treatment with counceling 3 times a week, and a bunch of other bullshit.
.............My first day of drug court I was tested positive for marijuana even though I haven't smoked in weeks since before I signed up, and was sanctioned by the judge to 3 Weeks in county jail. I never got into trouble even as a youth, so it was my first jail visit and the worst experience of my life. I've since been sanctioned for missing counceling to endless hours of community service, 2 NA meetings a day for 3 months, written essays, and a bunch of other bullshit.. I can't live my life LET ALONE get a job with all this shit from drug court to take care of, and I'm starting my second semester of college in the fall.


So I went and talked to a few other attourneys recently and got a really good one. He said I got completely screwed by the system and they found the only way the could to send me to jail for a non-jailable offense. And nobody gets out of drug court in a year, it usually takes 2 years anyways. He said from the police reports and my own story, that he should almost definatly get my case dropped for illegal search and seizure, but worst case scenario I would be released from drug court and put on probation for 1 YEAR at most since 3 years is way too excesive for my first A-misdemeanor with no prior record.. :woohoo:
.......I'm just really happy that all this shit might finally be coming together for me and I can hopefully get a lot of this bullshit off my chest. I might even be able to blaze up in the near future if my case gets dropped!! :D

Sorry if this should be in Security and Legal, I just had to share I'm pretty excited. Hoping for the best but expecting the worst! :joint:

damn ...it does sound like they railroaded ya.

ive had friends on drug court...they hated that shit too.

good luck gettin off it...sounds like your on the right trak.

sorry to hear that man. Try to figure something out. Also, is there really such a thing as "drug court"? That's messed up. Everyone working there would be the creepy lives-with-his/her-mother/socially awkward 30-year old type who take out their misery on innocent doobs

.... Even if I got off of drug court and put on probation for a year I'd be sooo happy because I could have a life again and hopefully find a job without having to worry about NA or AA meetings, random drug tests every week, counceling, and best of all I wouldn't have to stand in front of my asshole judge every Tuesday morning scared shitless. I still might not be able to blaze for another year, but to hell with this drug court

wishing you the best bud, i had a friend get let off for illegal search and seizure. when all came down the judge told the cop he had no right to make a traffic stop for an unreasonable cause even if someone told him anything. if there wasnt a search warrant he was just trying to be a dick to you.

Sorry for all the misery bro. With the more experienced representation, your odds are a whole lot better. Hope you will be able to put this behind you, and get on with your life :D

I really hope so.. My first lawyer was very young and didn't know how to handle my case. My new lawyer is pretty old and handles a lot of criminal cases like mine in the area and has been for decades, he definatly knows what he's doing. I start college again in the fall and I just want my life back!

Seriously and I only did it for the free or cheaper smoke!! It's the hydrocodones that got me with the A-misdameanor. If I was only caught with weed, I would have a civil citation and a max $100 fine.. It sure would be excellent to be able to smoke up again :joint:

I'm glad you got off....those charges were hella crazy... I think they wanted to make an example out of you since you had those pills.

well looks like im probably not getting off completely but im most likely looking at a year of probation instead of at least another 14months of drug court. still cant smoke for awhile which really sucks, but probation is a lot less intensive and time/effort consuming as drug court. which is really good cause i just started classes again and will have a job soon. wish me luck!! court at the end of the month

Wow, that first lawyer really sucked, that sounds like a deal that your average assclown public defender would get for you.
Good luck with the new Attorney, sounds much better.

the sad part is my first lawyer wasnt even a public pretender. she was just very young and naive to the situation and didn't know how to handle my case.. and also costed more for my first attourney than my second and my 2nd lawyers doing a better job

I bet the drug counseling meetings are a blast though. I'd have a hell of a time going toe to toe with the ex-junky counselor trying to convince everyone that pot is the devil.

So my court date is a week from today, Thursday September 24th.. I'm assuming I start my year of probation than. I hope everything goes smoothly, wish me luck everybody!
