I got busted with well under a gram of hash and then long story short the lawyer has some sort of plea arranged, don't know what yet. But I have a deposition date set up and I'm just wondering what to expect. If I plead guilty then, I end up with the record, does this bar me from going to the states? Am I looking at jail time, I really don't know what's going on with this government.
what??? you needed a lawyer for under a gram of hash? in Canada???? this is a serious shock to me

If you don't have a record then a fine will be the outcome and yes you won't be able to enter the U.S.A.


It sucks having a government going backwards on drug laws.

hmm. Not to discount your experience, but my question is what else were you doing when you got busted. Doubtful you were just walking down the street smelling the flowers. The cost to prosecute for less than a gram of hash will have the judge fuming made.

Were you driving or causing a disturbance as well? No other charge than posession?

Busted for cannabis in canada (posession) is a summary convinction. Enless harper has changed something.

I heard about US criminals not allowed to go to Canada without a permit, but never the other way around. Good thing there are tons of ways to get around that, just not the road, rail, or plane, I'd watch for coat guard too. They don't usually have combat swimmers, so just go without bubbles. I would like to get a permit to take a train up through Canada, it just looks awesome. Some nice horse riding and cabins as well, but the train is something to feel depressed about coming home from.

your not looking at jail time. i was arrested with 40 lights 2000 plants and 50 pounds. i plead my charges down to 3 months house arrest 6 months probation and the return of about half my property. for your charge if your going to make a plea deal you should insist on an absolute discharge. that way one year after any probation or community service the rcmp are severely limited on disclosing that youve ever been charged with an offence. with a conditional discharge it takes three years.
 
t.o. med, that's funny (no offence), house arrest. Sometimes they just aren't thinking. I'm trying to think what you could possibly do home for 3 months, without leaving.

And Limeygreen, if my tax dollars are going to prosecute you because you had less than a gram of hash, i say we publish this incredible waste of money.

you ain't going to jail, summary conviction if anything. A buddy of mine got busted for blowing over 0.08, never convicted, crazy but true.
 
Not trying to make light of your situation Limeygreen, but I am certainly in agreement with some of the other posters sentiments. If it is merely a simple possession charge involving a gram of hash, I would tell a lawyer who suggested a plea bargain not only to pack his bags, but pack some salt up his ass while he's at it!
Unless there are some extenuating circumstances which you haven't mentioned, such as additional charges or a prior criminal record for instance, you almost certainly wont be doing any jail time in Canada for possession of a gram of Hash.
IMHO opinion at least, if a plea is the best your lawyer says he/she can do for you, I would personally suggest that you find yourself better legal representation, and take your case to court.

It was at a roadside block while I was driving. I had put a bottle of open liquor on my front seat and didn't have my lisence on me at the time. They made me wait in t he cold for about 40 minutes, take my jacket off and hat off while laughing in minus temperatures searched my car illegally, no evidence from that search, towed it then had their boss tell me in the morning it was because i was hammered but they never gave me a slip or anything. Told me I was probally being given a notice to appear because I wouldn't tell them who I had gotten it from. Gave me a youth court notice although I am above the age for that court then came to my house to give the other ticket only for me to be a stupid idiot and take the copy without signing the new notice. When asked about signing it I had asked if I was required to sign it by law twice and both times he told me yes, then I asked if could talk to a lawyer first and he said no and he was filing the charges that night. They waited at the roadside stop until all the other cars were gone, never asked if they could search my vehicle and only tried to get me to call someone for a ride, the real reason they towed my vehicle.

I know I fucked up but so did these cops, he was running around at the stop with people still being stopped saying things like Look at what I got, I got some hashish as if he had just won the lottery.

My lawyer never suggested filing harassment charges or complaints, is it too late to do it?
Am I just an idiot and have to take the plea?

I also would like to get some feedback, I'm a citizen of two eu countries, will this affect my travel to these countries, one being the UK?

It sounds to me like you have grounds to fight the charge. I suggest you suck up the loss on your retainer fee for your current lawyer, and find yourself one who is actually interested in defending his clients and protecting their rights. Too me I see several different angles to fight the charge through, first being the improper ticketing, giving you a youth court summons and then another ticket on top of that. Secondly, by denying you the right to council, the arresting officer has violated your constitutional right to legal council. I bet he was stoked about the hash cause he couldnt wait to get off shift and smoke it with his buddys.

fatcat666 i was arrested in october 2003. i wasnt sentenced until 2006.

t.o.meds, you should move to BC. I doubt you would have been sentenced then. Probably just a 20k fine or some shite like that. There was a guy popped a few years ago now with over 100 lights and he ony got a 40k fine hehehe.
