no update update, went to meet the feds AUSA for my proffer session and as soon as I entered the federal building I got a call telling me that the meeting will have to be re-scheduled. Thanks to all the well wishers, and all of the dickheads can fuckoff. I'll update later with any new news.

you know, I was thinking the same thing but was not gonna post it out of respect to chris....so I researched it a little bit, called a NORML lawyer and just asked a few questions and apparently its common practice to use the safety valve a little more nowadays........scared me a little at 1st, so I wanted to research for myself before I posted in this thread. I think its all good.

a safety valve is a statute that allows the judge to depart from the mandatory minimum of 5 yrs. To qualify you need to have less than 1 criminal history point, did not kill or hurt anyone in connection with the crime, not have a firearm in connection with the crime, not be a leader of others, and debrief about all of your actions concerning your crime. This will allow the judge to impose a sentence below the mandatory. With a departure it will put me at a level 18, another 2 level reduction for acceptance of responsibility will put be at a 16 which is 18-24 months I think. A 5k1 reduction is given to snitches, if snitching meant not going to prison not sure what I would do, but fortunately I don't know shit.

The safety valve is basicly earned by a first time offender being charged with a drug charge. the debriefing is the earning part, you have to tell all about your crime, well, all that they need to know anyway. As far as they know I am a solo act.

the main focus of the meeting will be to get you to inform on people you know. that is pretty much their only objective. if you dont, you will find them going from playing softball back to hardball. hopefully, you have a strong attorney with good relationships in the prosecutors office. even if you dont know anyone to roll on, they assume you do and wont believe otherwise. it is a real crappy situation to be in.

Had my meeting with the AUSA, DEA, and the county task force that originated the tip. Everything seemed to go well, I told them everything I did involving my crime from start to finish and that should satisfy the criteria for the Safety Valve. The detectives said that it will be some time before they are done investigating my statements and then they will submit their case report to the AUSA for indictment, and then after that happens my lawyer will start to do his work to get me the best deal possible. I'm just glad things are moving forward now.

On another note though if that usual 20k lawyer cant get you a good deal and he starts becoming less confident and convincing with his sales pitch, you should take the switz idea.
