Its a ticket in my neck of the woods. I did get stoped one time and the cop asked me if he could search my ride. So i let him and he found a pack of zig-zags in the glove box. Wrote me a ticket for paraphernalia. No pot at all nothing. SOB was looking hard to for stems seeds spillings ect on the floor......NO POT means the papers could be for rolling cigs i guess. Dick still wrote me a ticket for paraphernalia so i got my ass a lawyer and went to court.....Did not have to say a fucking word or be in the court room for less then 15min. Dismissed! Waved by to mr. piggy and drove the fuck off. Hate the fact that stupid shit like this goes on. Just another way the fucking local cops stay funded. Shit heads. I feel for your bro man hope all turns out well for him. Or as good as it can. Get a lawyer is my advice. Sure you guys have that covered. BamBam

I would've done the same thing lol, a ticket for zigzags. I would've told him straight up to kiss my ass because that's no reason for being stopped.

The issue is more of, he wasn't stopped FOR the zig zags but once he consented he THEN got busted for them.

the only thing im worried about is that the pipe dropped outta his pant leg and the cop found it

P.S. If it's china made glass, he should have ground the glass into the asphalt with his heel over and over again, can't bust you for glass particles.

Maybe not, but in a lot of states that's a great way to turn a misdemeanor into a felony. Destruction of evidence.

honesty saved my ass when i got popped. was waiting on a friend, cop rolled up, asked if there was anything in the car, i told him about the tray with a grinder and a little pot under my seat and he went ahead and searched. found a bong in my friends backpack which i didnt know about. had to break the bong and get rid of the grinder. let me off solely on my honesty. said if i had lied i would've gone to jail.

What grounds did he have to search you? Sounds like you weren't even on the road...

Also check if your state has a "conditional discharge" law. Any misdemeanor and in some cases also felonies can be expunged later. But you can only use your conditional discharge on a non-violent 1st time offence. Usually the person will get probation and if its a drug charge probabily will have to submit urine screens as well. But this will keep you out of jail and give you a chance to clear your record later. It cost a friend of mine about $1,500 to get her record expunged.

well found out some more details


the driver got a MIP, DUI, Possession, and a bunch of vehicle related charges (winshield, seat belts, blah blah blah)

the girl he was with got 3 counts of MIP cause of the booze

and my little bro got possession of paraphernalia

my question is that if he only got sentenced with possession of paraphernalia can any of the other charges on anyone else overlap into a court case? or can only the charges you were convicted of be tried over?
also can my brother get into any more shit since he was trying to hide the pipe initially?

sucks he's being charged as an adult. Here in my state it would be expunged when he turns 18. Hell even after 18 you can use the proper channels for expulsions.It will cost a couple bucks but a having a clean record for any reason is always a plus, especially if he is planning on furthering his education. The feds(FASFA) dont help those with drug charges of any kind, sad but true.

I take it possession of paraphernalia would be a drug charge...

hes been arrested before just for being out past curfew and such, but he was never convicted of any actual crime. Would this misdeameanor be consider his first offense? (ie maybe he can opt for just probation and it be exponged or is that just downright unlikely)

Satori, yes this will be considered his 1st offence. That curfeiw thing is nothing. You have to check on your state laws. Where is he being tried? Municipal court? or County Court? I'm pretty sure he can opt for a "conditional discharge". He'll get probation and when he conpletes he can get the charged expunged. But only if he gets the conditional discharge. Also are they all being tried together?? If they are being tried together the charges can overlap. The possesion charge can overlap, but not the traffic charges. I'm thinking this will take place in municipal court and if so they might be tried altogether. Did he get a written summons? Or did he have to pay bail? I do reccomend getting a lawyer. Also if he can get this expunged he will need a lawyer to do so. Also like some-1 said above if he has a drug charge, and yes even paraphenalia, he will not be granted any federal loans or aid when it comes to college or a Tech School. If you need anymore answers feel free to ask.

I dont even know how to tell my little bro bout the student loans things...

this is a sad day.

I'm gonna look into a lawyer, if he could get it expunged could it be possible to still qualify for student loans?

if so, I'd say pass on hiring a lawyer.
use the free court appointed lawyer.
1st timer pot possession offenses automatically
get it expunged after completing probation anyway.

usually a year of probation with 12 step + shrink sessions
is standard punishment but it really depends on who the judge is.
A lenient judge might just give you a fine and community service.
Wouldnt that be nice. Thats where hiring a lawyer that knows the judge well could make a difference. Call a few lawyers for the free consultation. Its a real PITA, finding a decent lawyer is as bad as finding a decent construction contractor.

well thats not my biggest concern as of now, I'm just wondering about his student loans. I mean shit I'l grow everything i need to pay for his college if i fuckin have to but I just dont want to have it come to that.

if it will get expunged after probo and such, would he qualify for student loans then? does this mean he'll have to take a year off? (hes a senior and we dont have the money to pay)

being cooperative CAN be the difference between a summons and a trip to jail for paraphenelia...once he smells it you're fucked 99% of the time

sure the cop can't prosecute you, but he sure as hell decides what you're charged with....if you think being stubborn/denying search is a good way to get rid of cops at your car door then you're either stupid or you've never been put in that situation

Trust me never be co-operative. The prosecuter decides what to ultimatly charge you with based on the evidence they have. Cops just pack on everything they can and most things get thrown out of court. They are going to find something on you either way, by co-operating and letting the police know that you have something on you or in your car automatically waves your rights of being silent and makes any chance of going to trial non-existent. Because you have already admitted guilt.... Get it?? Just say your name and be quiet!! Never consent to a search. Ask any lawyer, he will tell you the same.

Knowing your right and using then to your benifit is smart not stupid. Waving your right admitting guilt and hanging yourself in at the mercy of a police officer, now that is stupid. Ask any lawyer what you should do if you have been pulled over for anything. Even if you have a blunt burning in your hand at the time you still never admit it.... Even if your busted either way. Don't give consent, don't admit guilt, give them your name and no story at all, call your lawyer.
