Got a ticket. Never recieved a notice to appear.

I got a ticket on October 18th 2008 for CVC 21111 (which I couldn't even find that particular CVC on the internet) and never received anything in the mail about it.

I was in a friends car and accidentally dropped my cigarette out the window. I ashed out the window and the wind from driving on the freeway blew it out from between my fingers...
I didn't have my license on me, so the cop just took down my information. Everything on the ticket seems to be in order, all the information is correct, but I can't find that infraction number anywhere on the internet (CVC 21111).

Does this mean my ticket was misfiled or something?

It was written by a park ranger if that makes any difference.

I am supposed to appear at 7:30 tomorrow (Nov 7th)

Local authorities may adopt rules and regulations by ordinance or resolution regulating vehicular traffic on privately owned and maintained roads or ways within the boundaries of any housing project or within the site of any housing owned or operated by a housing authority created under and by virtue of the Housing Authorities Law, commencing at Section 34200 of the Health and Safety Code, on privately owned and maintained roads or ways within areas which would be a residence district if the road or way were a public highway, or, with the consent of the owner, on publicly owned and maintained roads and ways within areas which are not owned by such local authorities. The rules or regulations shall not be effective until appropriate signs giving notice thereof are posted along the roads or ways affected.

Wow, you are lucky you found out about your date in time. The notice to appear info was not on the back of the ticket?

It says that my court date is for tommorow, the 7th, but I have always gotten something in the mail about having to go to court.

Once I had nothing mailed to me, called the courts, checked to see if the ticket was in the database, but nothing.

I tried doing that today (just remembered I even HAD gotten the ticket :bashhead:) but was unsuccessful at getting a hold of anyone!



I HATE THIS TOWN!!! The cops here are nazis!!

Many many moons ago I was pulled over for speeding. (guilty..... waaay guilty)

Wrote me a ticket and let me go. SOP is to wait 2 weeks and call in to find out when to show for the court date. (gives the officer time to file it in the system)

I waited and called and NOBODY could give me any information on it or even FIND ME in the system. Hrmmm......

I even FAXED THEM A COPY of the ticket to ensure that everything was kosher.

2 years later I get pulled over because I was driving someone else's vehicle. They had re-registered their vehicle and FORGOT to put the tag on the license plate.

Guess who went to jail for failure to appear for a court date?
Yeah buddy! Me.

I'm really tired of incompetence.

this has happend to me 2 times this year. basically the cop has an infinate amount of time to enter the ticket into their system, and it's YOUR responcibility to check every week until it's taken care of. I found out the hard way.
1 warrant for FTA & suspended licence for 6 months (to wait for my new court date)

edit: hope you went by the date stated on the ticket, atleast the court will give you a paper that shows you atleast went to the courthouse by the date stated. gives yourself more credibility to the judge WHEN you see him.

Why are you playing around with this? Did you go to court in spite of not getting an engraved invitation? You are just asking to have a stupid mistake/bad habit (you're a litterbug) turn into something much more severe.
 
as the court has said many times when i've been there, the notice they mail you is a 'courtesy'. they dont have it served, or even send it certified mail, because its just a courtesy notice and you're expected to appear because you were given a date on the ticket and you signed it acknowledging that. FTAs are expensive (315 in my county and thats if you show up in court before you get taken in by the cops, it goes up from there), just go to court and deal with the ticket.

Always go to take care of your tickets.If your not sure ,show up anyway .Im sure there is some date on their.I accidentally missed a court date for driving on a suspended liscence(my payment was late for speeding fines).

They issue a warrant for your arrest,The judge and court basically take it as a big F--You.I went and turned myself in. i walked into the jail ,paid the bond ,they set another court date and i walked out .

Made it to that date,and my fines were already paid so they threw it out ..

Always show up no matter what......That way at least they know your trying..

The really bad thing about having an FTA on your record is if you ever need bail it's going to be an inflated amount, or maybe even get you remanded.

5 years ago I got pulled in NY state for 9 over in the slow lane. I lost the ticket (moving to upstate NY and lost it in the clutter) and called them and could not find out anything. Years later I got pulled for not having a front plate in NY (ok since I had MA plates) and they ran my license and told me ok alls well.

Should I call them back and find out if I am a fugitive somehow?

If it'd been 5 years and there's no suspension on your license I'd probably leave well enough alone. If you're worried go to your local DMV and ask them to run your license for suspensions....

I kind of have the same feelings, I guess I could call up the police in Albany and ask too. It sure as hell never showed up on my insurance, seems like 1/3 to 1/2 of moving violations from out of state have not showed up at all on my insurance points system.

My license has defiantly never been suspended, I was almost arrested once for a moving violation and they DEFIANTLY would have used that against me if they could in court.

I don't intend to move back to NY or be there for any extended period of time anyways so I'll probably just let it sit, it was only 9 over on the interstate for gods sake.

County Employees are the ones who put this stuff on their computers...if they miss a few here and there, it is not surprising-- It also could have been a DA reject-- Either way, I would not ask them about it...7 years is the statue of limitation--

Yea I was wondering about limitations on small stuff like this. I wasn't going to do call them, had the same thought after I read my post. Not like I am going back to NY anytime soon anyways.

In NY, the statute of limitations is two years on a misdemeanor and five years on a felony.... except for murder, where there is none. On a traffic infraction, if the driver fails to appear as directed on the ticket, there is none, although common sense tells me they probably lost the ticket...
