question about federal charges

whats up guys

i know in order for you to be charged federally you would have to have over 100 plants. but is that the total number of plants or the total number of plants being flowered? i think i can figure out the answer, lol but if its the obvious, can a lawyer argue that the plants being flowered were < 100?

thanks

(i searched the threads and saw no answer to this particular question)

they can even count rootballs from previous plants if they find them. It's the total number of plants you have. They are only supposed to count 'rooted' plants but I bet most would take pictures of clones rooted or not and count those also, and swear up in down in court that they were rooted.

I don't know the exact answer to your question, but I'd imagine if it were anywhere close to that number the popo would try to bump you up (count cuttings as plants, etc). Best bet is to make sure you're well under that number, imho...

figures. i would hope a good lawyer can argue otherwise. maybe i should start taking daily pics so in case the worst ever was to happen, id be prepared with pics of the actual count, lol.

The DEA can bust you for a single plant, I don't what where you got 100 from !?!

i guess i have been misinformed. it was always a rule of thumb to have under 100 plants. Not that your allowed to grow any number of plants, but over 100 stiffer penalties come about. Isn't there a mandatory 5 yr minimum sentence for over 100 plants?
