US State Law - OH

I was just checking up on some local laws and I'm left with a few questions unanswered. I've been looking, but to no avail. I thought I would turn to good old icmag. Maybe someone here could shed some light on the subject.

Cultivation laws in OH are determined by plant weight, which I'm sure is similar to some other states, but what defines this plant weight? Would this be the actual weight of the plant, regardless of growth stage? This seems to be the logical conclusion for me. If you get busted with only vegetative plants they would charge you with something, and the only thing they would have is your plant weight. What if you were to be busted in the middle of harvest? Would you then be charged with both cultivation and possession? Another thing I was thinking about...how is cultivation treated in states with no cultivation laws? Does everything then fall under possession?

If anyone has any insight into these matters, please share. Any feedback is much appreciated.

Sorry. I ran a search for Ohio's official site, looking for the actual laws, but NORML seems to have bought all the top slots for Ohio's Marijuana Laws.

You should find the Official Ohio website and read the actual law. I couldn't find it.

Thanks for all the responses. I originally checked out the norml site and then followed that up by searching for the official OH .gov site. I read through the laws and I see where norml got their info, but I failed to find the information I was really looking for. I'll keep looking though. Looks like a sog or scrog is in order eh?

CC that was exactly my thought. I could see them weighing dirt and all. Maybe they would weigh the res if I was doing hydro. Try to pull funny stuff all the time.

Seems like I live in a pretty good state for the personal grower. Of course the idea is not to get busted, but just trying to prepare myself for the worst case scenario.

You will have to be carefull, there are two sets of laws that you can be charged with; State and Federal. In many instances whoever can offer the harshest sentence will be the one to press the charges. For instance, if you have 50 seedlings Ohio has the opportunity to charge you with cultivating a few ounces; but the feds can charge you with cultivating 50 plants which is much more severe. Most states have a certain cuttoff point after which they hand the case over the Feds, you can find this out by calling your state attorney generals office; despite they nature of the question they will answer it.

Do they use just the roots or soil and all? If they include the soil do they let it dry out before weighing? :rasta:

In Ohio, they will weight the entire root ball, plant, leaves, EVERYTHING. If your lucky they will shake it once, but don't count on it. Use hydro and small rockwool!!!

duder my good friend got poped they pulled the plants from container soil and whatever came with then weighted he only had about 16 plants. some state go by plant numbers some go by total weight :badday:
 
I would not be surprised if different police depts. used different methods even within the same state. I would be shocked to learn that LEO's follow the rules all the time. I would say the nicer you are to the LEO's at your door, the easier they will be on you. I guess you just better hope they are having a great day!

friend of the fam got busted and the cops weighed every just tugged his plants out the pots and weighed the dirt with it. they charged him with lbs. when he only had a couple ozs. for actual smokable material
