Zina In Islamic Law: Definition, Requirements For Proof of Zina And Punishment:

- The Zina Ordinance, as defined by the statutory criminal law of Pakistan, deals
with fornication, adultery and rape and provides evidentiary requirements and
punishments for them, treating them as related offences. It specifies the punishments of
stoning to death or public flogging for both offenses if certain evidentiary requirements
are fulfilled.

However, by looking at the Pakistani legislation, it appears that the legal
definition of zina blurs the distinction between zina and rape. For the purpose of the
ordinance, both acts of zina and zina-bi’l-jabr (forced illicit sexual relations, i.e., rape)
are defined as “sexual intercourse without being validly married.” Clearly, the only
difference between the two acts (and it is a major difference) is that rape occurs without
consent. This difference has major legal implications.

Indeed, under current Pakistani law
if a woman cannot prove that the sexual act occurred without her consent (i.e., if she
cannot prove that she was indeed raped), the sexual act itself becomes a crime against
society and therefore, the woman becomes liable for the hadd of zina.


As a result of this approach, instead of protecting Muslim women from violence
and rape, Pakistani zina laws effectively punish raped women for reporting crimes
against them and their families. Consequently, these laws have a devastating effect on
the reporting of such crimes. Further, Pakistani rape laws have proven to be counterproductive over the years, having resulted in an alarming increase in rape. Once we
know that in Muslim societies, acts of rape typically do not impact the individual woman
alone, but severely impact her extended family as well, we start perceiving the alarming
scope of the problem. Yet the ideal Muslim state is not one where reports of crimes are
decreased for fear of retaliation or punishment. Rather, it is a state in which each victim
is encouraged to appeal to the wali (head of state), the qadi (the judiciary), or ahl al-hall
wa al-‘aqd (community leaders/ representatives of the people), for justice and relief in
accordance with divine ‘adalah

Clearly, the roots of the problem are not religious, but are found in a Jahili3
behavior in society which must be uprooted. They can also be found in the erroneous
application of basic Shari’ah principles to the evidentiary requirements and the
assignment of the burden of proof in rape cases. As these stand, they place an
unreasonably heavy burden on the victimized woman. Furthermore, rape laws in
Pakistan commit a serious conceptual error by conflating the crimes of rape and zina,
something that traditional jurists were keen not to do. The cumulative effect of these
errors, combined with Jahili behavior, has resulted in grave harm to Pakistani women and
their families. This unfortunate state of affairs is intolerable for the maslahah (wellbeing) of the ummah, and must be addressed by the wali, the qadis, and ahl al-hall wa al-
‘aqd through both extensive education and the promulgation of better, more effective
laws.

* So in Pakistan - if a woman is raped and does not have 4 men as witnesses - (no women are allowed as witnesses) - to the rape in the court - and she falls pregnant - and is unmarried - then she is accused of zina - she then can be stoned to death?!! - most of these Pakistani rapists/groomers grew up in Pakistan - so were used to the ridiculous rape laws in their own country - then come to England and still abide by what they think is acceptable and what they can get away with under Sharia law IN ENGLAND - and behave atrociously towards the English girls - as if they were still in Pakistan - do we really need more men with this mind-set in the UK? - Those of us with young daughters particularly - say no -

- The UK is home to the largest Pakistani community in Europe, with the population of British Pakistanis exceeding 1.17 million based on the 2011 census. British Pakistanis are the second-largest ethnic minority population in the United Kingdom and also make up the second-largest sub-group of British Asians. - so you could probably add another million to that - since the total was 10 years ago - legal and illegal Pakistani's in the country - half of them at least would be men - many of which are quite recent arrivals - all used to Sharia law in their own country - and obviously its proving to be quite a problem -

When Richard von Coudenhove-Kalergi outlined his idea for a unified Europe in his book Paneuropa in 1923, the Tokyo-born Austrian politician had no idea that almost a hundred years later his name would be associated with an imaginary plot to wipe out white people through immigration and intermarriage.

Kalergi was a tireless advocate for European unification, and served as president of the Paneuropean Union for almost fifty years. A liberal-conservative, he opposed both communism and racism, hoping that: “today’s races and classes will gradually disappear owing to the vanishing of space, time, and prejudice.” Adolf Hitler’s Nazi Party bitterly attacked Coudenhove-Kalergi, asserting that his vision was a masonic plan to enslave Europe.

Coudenhove-Kalergi left Freemasonry in 1926. Nonetheless, today’s references to “the Kalergi Plan” are common in right-wing websites and speeches. The conservative non-profit group Turning Point USA recently tweeted a photograph of its members encouraging people to educate themselves about the dangers of the Kalergi Plan, and the conspiracy theory is reported as fact in online news sources, such as Slovenia’s Democracija, Germany’s Epoch Times and Austria’s Zur Zeit.

A Twitter search for the hashtag #Kalergi produces thousands of tweets from people warning that “the replacement of indigenous Europeans with ‘diversity’ is the ultimate goal of the ‘globalists’” and that “We caused the population explosion in Africa. Now we are enjoying the consequences. Europe will be African within a century.” The former British National Party leader, Nick Griffin, associated the Kalergi Plan with “Soros-backed leftists” in Czechoslovakia, who were apparently trying to prevent local television stations from reporting the “truth” about Muslim immigration. Most recently, right-wing bloggers have begun associating the “black Jewess” Meghan Markle with the Kalergi Plan.

How did the Kalergi Plan become a major trope of right-wing discourse, when just two decades ago this alleged plan was virtually unknown? The apparent success of this conspiracy theory is as puzzling as it is distressing. It is a remarkable example of how globalized right-wing discourse has become in the last decade and how it openly resorts to tropes and claims originating in Nazi propaganda.

The Origins Of The Kalergi Plan Conspiracy Theory
In November 1940, the Völkischer Beobachter, the infamous official daily paper of the Nazi party, claimed: “Count Coudenhove-Kalergi […] the commercial prophet of Pan-Europe, a dressed-up, nasty mongrel, dreams of a world of Eurasian-Negroid humans, subject to the God-given rule of the Jews.” This claim was based on a distorted reading of his books combined with outright fabrications. Another Nazi newspaper asserted that Coudenhove-Kalergi was supported by “international Jewry and Freemasonry”. Coudenhove-Kalergi was not Jewish, but he did vehemently opposed anti-semitism – as had his father Heinrich, who had written his dissertation on the character of anti-Semitism.

For the Nazis this was proof enough that he was indeed an agent of international Jewry. Further proof was, that – as an opponent of Nazism – Coudenhove-Kalergi had colluded with the fascist Dollfuß-Schuschnigg regime (often termed Austrofascism), arguably the (Austrian) Nazis biggest rival. In 1938, Coudenhove-Kalergi fled Austria and eventually lived in the United States until 1945.

Couvenhove-Kalergi returned to Europe after the war, dying in Austria in 1972. Postwar agitation against Couvenhove-Kalergi was mostly confined to the radical right and neo-Nazi circles, whereas the conservative right hailed him as a prophet of European unity. This changed in the early 2000s. In 2003, Gerd Honsik, a prominent Austrian Holocaust-denier and Neo-Nazi, who had evaded imprisonment in the 1990s by fleeing to Spain, self-published a book about the alleged Kalergi Plan.

The book, written in German, is now out of print. A translation of the book is however available online in Croatian. Honsik might have even coined the term “Kalergi Plan” himself, but the book’s content came straight from Nazi propaganda of the 1930s and 1940s. Although Honsik was a convicted felon on the run, he had remarkable connections to the then-governing Austrian Freedom Party (FPÖ) and other right-wing circles, and promoted his views extensively on the internet and through far-right publications. Honsik’s theories thus infiltrated more mainstream right-wing discourse.

Around 2005, Honsik also published an open letter to the Austrian and German presidents in seven languages, alleging that the United States purposely committed a genocide of 13.2 million Germans after 1945 and had – among a number of strategies – resorted to the “Kalergi Plan”, in order to implement this “genocidal” goal. This letter is still available on international “revisionist” and Holocaust-denial websites in different languages. Honsik’s book was also discussed in 2006 on the American Neo-Nazi internet forum, Stormfront. These are perhaps the earliest examples of how Honsik’s “Kalergi Plan” myth found its way into the American and international radical right.

Meanwhile, in Hungary, Prime Minister Viktor Orbán has popularized his own iteration of the Kalergi Plan myth: the Soros Plan. Over the past few years, Orbán’s regime has attacked the billionaire philanthropist repeatedly. They accuse him of masterminding attacks on the Hungarian nation through “liberal” educational institutions, such as Central European University, and of convincing the European Union to accept refugees.

In 2019, the Hungarian government claimed that Soros was working together with Jean-Claude Junker to “to weaken member states’ rights to protect their own borders”. The eternal return of the Kalergi Plan (and its variants) suggests that – despite unparalleled access to information – our society has still not come very far beyond those which believed the Illuminati were the masterminds behind a new world order, or that The Protocols of the Elders of Zion was an accurate record of a Jewish conspiracy for world domination.

- Call it what you will - I see it happening around me - with millions and millions of legal and illegal migrants pouring into the UK over the past 50 years - with very few migrants coming to Britain before the UK joined what we thought was a 'Common Market' back in the 70's to trade goods and services only with the rest of Europe - No one was told that this would lead to political union - and that we would have to open the UK to anyone that arrived at our shores with the latest cell phone - in designer sportswear - after passing thru several 'safe' nations - and after giving thousands of euro's to 'people smugglers' pretending that they are 'refugees' - these people then often get housed in hotels and are given public funds and benefits to live on - few ever actually get a job and contribute to the society that supports them - and few ever leave - once they become accustomed to the generosity bestowed upon them by the British people -

-I'm sure there are a lot of immigrants in England, both legal and illegal. It did not start in the 70s when you joined the common market, but began post war to help build the economy. Just because there are immigrants in your country, it does not mean that came about because of a conspiracy devised by Kalergi. If you accept the Kalergi plan, you also have to accept that there is a secret class of rulers who devised this. I don't see any evidence of that. There's a difference between predicting something, and devising a conspiracy to see that happen.

All I see is a country trying to revive it's economy with migrants after a brutal war. It turned to it's Commonwealth countries to provide the labour.

They included Hindus from the Gujarat region of western India, Sikhs from the eastern Punjab region, and Muslims both from the west part of Pakistan and from East Pakistan, which became Bangladesh in 1971."

There is similar migration to my country. I think a quarter of people in Australia were born overseas. My understaning is that our countries economy depends on this. Does it cause problems? Yes of course, but for the most part it is accepted. It has changed our culture, in my opinion for the better. However some things aren't the same. We no longer drink massive amounts of beer, eat meat pies, peas and boiled veg, and listen to ACDC (well some of us do). :gday:

- Britain didn't get involved in what I would call mass immigration - until the 1970's - before that and throughout all of British history we had what I would call 'controlled immigration' - very few migrants came to the UK in comparison to recent times - and most assimilated well into British culture - so becoming British themselves - As I went thru school in the 60's and 70's - it was a very different demographic than it is today - of course things change - but at the speed I have seen change happen - it has not been good for many native Brits - their culture and society - villages - towns - and cities - have been swamped by often invasive cultures from outside the UK - bringing much crime and a distinct clash of cultures because of it - with many thousands of casualties already -

-I'm sure there are a lot of immigrants in England, both legal and illegal. It did not start in the 70s when you joined the common market, but began post war to help build the economy. Just because there are immigrants in your country, it does not mean that came about because of a conspiracy devised by Kalergi. If you accept the Kalergi plan, you also have to accept that there is a secret class of rulers who devised this. I don't see any evidence of that. There's a difference between predicting something, and devising a conspiracy to see that happen.

When Richard von Coudenhove-Kalergi outlined his idea for a unified Europe in his book Paneuropa in 1923, the Tokyo-born Austrian politician had no idea that almost a hundred years later his name would be associated with an imaginary plot to wipe out white people through immigration and intermarriage.

Kalergi was a tireless advocate for European unification, and served as president of the Paneuropean Union for almost fifty years. A liberal-conservative, he opposed both communism and racism, hoping that: “today’s races and classes will gradually disappear owing to the vanishing of space, time, and prejudice.” Adolf Hitler’s Nazi Party bitterly attacked Coudenhove-Kalergi, asserting that his vision was a masonic plan to enslave Europe.

Coudenhove-Kalergi left Freemasonry in 1926. Nonetheless, today’s references to “the Kalergi Plan” are common in right-wing websites and speeches. The conservative non-profit group Turning Point USA recently tweeted a photograph of its members encouraging people to educate themselves about the dangers of the Kalergi Plan, and the conspiracy theory is reported as fact in online news sources, such as Slovenia’s Democracija, Germany’s Epoch Times and Austria’s Zur Zeit.

A Twitter search for the hashtag #Kalergi produces thousands of tweets from people warning that “the replacement of indigenous Europeans with ‘diversity’ is the ultimate goal of the ‘globalists’” and that “We caused the population explosion in Africa. Now we are enjoying the consequences. Europe will be African within a century.” The former British National Party leader, Nick Griffin, associated the Kalergi Plan with “Soros-backed leftists” in Czechoslovakia, who were apparently trying to prevent local television stations from reporting the “truth” about Muslim immigration. Most recently, right-wing bloggers have begun associating the “black Jewess” Meghan Markle with the Kalergi Plan.

How did the Kalergi Plan become a major trope of right-wing discourse, when just two decades ago this alleged plan was virtually unknown? The apparent success of this conspiracy theory is as puzzling as it is distressing. It is a remarkable example of how globalized right-wing discourse has become in the last decade and how it openly resorts to tropes and claims originating in Nazi propaganda.

The Origins Of The Kalergi Plan Conspiracy Theory
In November 1940, the Völkischer Beobachter, the infamous official daily paper of the Nazi party, claimed: “Count Coudenhove-Kalergi […] the commercial prophet of Pan-Europe, a dressed-up, nasty mongrel, dreams of a world of Eurasian-Negroid humans, subject to the God-given rule of the Jews.” This claim was based on a distorted reading of his books combined with outright fabrications. Another Nazi newspaper asserted that Coudenhove-Kalergi was supported by “international Jewry and Freemasonry”. Coudenhove-Kalergi was not Jewish, but he did vehemently opposed anti-semitism – as had his father Heinrich, who had written his dissertation on the character of anti-Semitism.

For the Nazis this was proof enough that he was indeed an agent of international Jewry. Further proof was, that – as an opponent of Nazism – Coudenhove-Kalergi had colluded with the fascist Dollfuß-Schuschnigg regime (often termed Austrofascism), arguably the (Austrian) Nazis biggest rival. In 1938, Coudenhove-Kalergi fled Austria and eventually lived in the United States until 1945.

Couvenhove-Kalergi returned to Europe after the war, dying in Austria in 1972. Postwar agitation against Couvenhove-Kalergi was mostly confined to the radical right and neo-Nazi circles, whereas the conservative right hailed him as a prophet of European unity. This changed in the early 2000s. In 2003, Gerd Honsik, a prominent Austrian Holocaust-denier and Neo-Nazi, who had evaded imprisonment in the 1990s by fleeing to Spain, self-published a book about the alleged Kalergi Plan.

The book, written in German, is now out of print. A translation of the book is however available online in Croatian. Honsik might have even coined the term “Kalergi Plan” himself, but the book’s content came straight from Nazi propaganda of the 1930s and 1940s. Although Honsik was a convicted felon on the run, he had remarkable connections to the then-governing Austrian Freedom Party (FPÖ) and other right-wing circles, and promoted his views extensively on the internet and through far-right publications. Honsik’s theories thus infiltrated more mainstream right-wing discourse.

Around 2005, Honsik also published an open letter to the Austrian and German presidents in seven languages, alleging that the United States purposely committed a genocide of 13.2 million Germans after 1945 and had – among a number of strategies – resorted to the “Kalergi Plan”, in order to implement this “genocidal” goal. This letter is still available on international “revisionist” and Holocaust-denial websites in different languages. Honsik’s book was also discussed in 2006 on the American Neo-Nazi internet forum, Stormfront. These are perhaps the earliest examples of how Honsik’s “Kalergi Plan” myth found its way into the American and international radical right.

Meanwhile, in Hungary, Prime Minister Viktor Orbán has popularized his own iteration of the Kalergi Plan myth: the Soros Plan. Over the past few years, Orbán’s regime has attacked the billionaire philanthropist repeatedly. They accuse him of masterminding attacks on the Hungarian nation through “liberal” educational institutions, such as Central European University, and of convincing the European Union to accept refugees.

In 2019, the Hungarian government claimed that Soros was working together with Jean-Claude Junker to “to weaken member states’ rights to protect their own borders”. The eternal return of the Kalergi Plan (and its variants) suggests that – despite unparalleled access to information – our society has still not come very far beyond those which believed the Illuminati were the masterminds behind a new world order, or that The Protocols of the Elders of Zion was an accurate record of a Jewish conspiracy for world domination.
