District Attorney Stan Garnett’s “War on Patients” must end. On August 6, he lost the case against Jason Lauve, a disabled medical cannabis patient who was acquitted by a jury of felony marijuana possession.
Garnett was extremely upset that Jason was not convicted, having poured all the resources of the DA’s office into this high profile case.

On August 24, a letter signed by several medical cannabis patients, caregivers and advocates was sent to Garnett asking him to discuss medical cannabis with concerned citizens who were forming a Medical Cannabis Policy Group. The purpose of the group is to determine the best ways to protect patients and their safe access to medicine.

The District Attorney ignored the offer to become part of a community discussion and instead has decided to file a lawsuit asking for an injunction on medical cannabis dispensaries. Since his tactic of attacking patients directly failed, the DA now wants to waste more taxpayer money to go after the patients’ caregivers through a different legal remedy. This will endanger patients by forcing them back into the black market.

Our invitation for the DA to work with the medical cannabis community is still open. The DA has a wonderful opportunity to meet cannabis advocates and caregivers and educate himself this Saturday at the Cannabis Health Fair from 10:30am to 4:00pm at the Humanities Building on the CU Campus in Boulder. If you want the DA’s office to stop wasting money on medical cannabis, please call them at 303-441-3798 and tell them to end their “War on Patients” and work with the community instead of against them.

I'm sure this should get interesting by the time its over and maybe this guy will work himself right out of his job...

Why not go after real Crime? Its strange this is the battle this guy chooses to fight.
Go after Meth labs, organized crime, pedophiles or fucking jaywalkers they are far more dangerous than someone trying to buy/sell a helpful but harmless plant.

He recently won the first Colorado medical marijuana jury trial when his client, Jason Lauve, was acquitted of possessing 34 ounces of medicine. Rob successfully argued to the jury that Article XVIII, Section 14 of the Colorado Constitution (Colorado's Medical Marijuana Law) allows a patient to possess any amount that the patient determines is medically-necessary."
Very interesting, we'll have to see how this unfolds.

IMHO the BC DA has already soiled his reputation on this issue. I don't think he will get any traction. What does raise my curiosity about this particular case is the legal precedent for a patient to determine his or her own need for medicine, and the amount necessary to treat their ailments. This could be a huge win for those of us in the MMJ community here in Co. :yummy:

there is no lethal dose and at the moment 0 regulation on quality

Plus you need more than one strain to medicate and some time shit happens and your plant dies, infested, or what ever..

Here is another article out of Eagle County that was brought to my attention.

EAGLE, Colorado — When Michael Hiland and Scott Zieglar were looking for space for a medical marijuana dispensary, they were already thinking hard about its location. Now the two are confident they're in compliance with a new county regulation that limits where dispensaries can do business.

The Eagle County Commissioners Tuesday passed a resolution limiting where medical marijuana dispensaries can do business.

Nearly a decade after state voters approved the use of marijuana for medical purposes, the first commercial dispensary opened this year. As many as three more are set to open over the next several weeks. The new regulation is a response to that sudden influx.

While the new, temporary rules — which will be replaced in the next 90 days or so by a more carefully-crafted set of regulations — limit where dispensaries can do business, the county can't completely ban medical marijuana stores.

County Attorney Bryan Treu told the commissioners that while state law allows counties to regulate a handful of specific businesses, that power doesn't extend to medical marijuana shops.

“If you don't have enumerated powers to do something, you can't do it,” Treu said. “But you can regulate via zoning.”

That's what the new regulations do, limiting dispensaries to areas limited to commercial or industrial uses. The regulation also prohibits shops within 200 feet of homes and public parks, and within 500 feet of schools or day-care centers. They also can't be within 200 feet of another dispensary.

Shops that are already open will be allowed to continue to do business in their current locations.

But Hiland and Zieglar said the state already limits where dispensaries can do business. That's why they picked the former Eagle County Sheriff's substation in Edwards for their shop, called the Holistic Healing Center. The partners hope to be open in the next few weeks.

In an interview last week, Andrew “Ziggy” Zweigbaum, co-owner of the New Hope Wellness Center, also in Edwards, said he, too, carefully picked a place to open.

Hiland and Zieglar said basically the same thing. They'll see patients by appointment only, and their dispensary will be on the lower level of a building, off street level and behind two locked doors.

Still, the sudden influx of dispensaries upset Buddy and Bonnie Sims of Edwards enough to come to the commissioners' meeting.

Sims read the commissioners a statement and asked that they ban any new stores and require business licenses for dispensaries. The county can't legally do either of those things.

Sims also asked the county to perform some sort of quality control on the products sold at dispensaries, an idea that commissioner Peter Runyon said has some merit.

After the meeting, Bonnie Sims, a school teacher for more than 30 years, said marijuana, whether for medical use or not, is still a mind-altering drug.

“We're making it seem like it's no big deal,” she said.

Sims, who said she has her own health problems, said she's learned to deal with pain and discomfort.

“I'm not going to take something that kills brain cells to take care of it,” she said.

But Zieglar, who suffers from Parkinson's disease, brought a large plastic bag of prescription bottles to the hearing. He said he prefers medical marijuana to treat his symptoms.

Jerry Olson, who recently opened Medical Marijuana of the Rockies in Frisco, said dispensaries give patients safe, secure access to marijuana.

“There's a need here, and a significant need,” Olson said.

But the need didn't really enter into the conversation about the regulations.

“Voters chose to allow this,” Runyon said. “We have to (allow) this, independent of any commissioner's feelings on the larger issue at hand.”

Colorado has some of the most anti cannabis prosecutors and legal eagles - who openly threaten to harass doctors that sign canna endorsements. Even after the majority have changed state law. There seems to be an under current, in law enforcement and judicial with a couple of stellar examples of the adage "Damn the torpedoes - full speed ahead" Denver PD has continued to attempt to file federal charges for persons in full compliance of state and city laws.

I suspect the proper course of action would to be file law suits for harassment against the county and the state and have the action signed by a few thousand tax paying legal voting age citizens as a class action suit.

I was at one of the dispensaries and chatting with a lady - she was afraid to tell her doctor cannabis worked better than what he prescribed -- People - we gotta let our doctors know cannabis is real, and we gotta let our elected officials know they will be held accountable for the actions of those people under them with private agendas.

I was at one of the dispensaries and chatting with a lady - she was afraid to tell her doctor cannabis worked better than what he prescribed --

Yeah some of... well all of the pain management places i go will have you fill out forms that you will be subjected to random drug test and we all know what they are looking for with UA's..

Anyway i will just tell them to get bent if they try and give me grief for mmj and go to another doctor. There are a lot of them..

Some Doctors think Marijuana is so bad they rather give out a Fentayl Patch because they think its safer.. (this happened to one of my friends And right now he is looking for another doctor but its a workman's comp type deal so he has to stop smoke. She gave him two months. lucky its not addictive like the shit they are giving to him Oxy to Fentayl) He has a broken back and they fused him all up and he is still in pain.
Some doctors really suck and would hand out opiates over cannabis any day. (I think they should be used together for pain management)
Then they will take the opiates away if they catch you smoking cannabis even if another doctor gave you the rec. and then you get to withdrawal from that shit...

I tell my General Practitioner that i use Cannabis and he says That's ok it wont hurt you.
