I disagree 100%. A lot of undercover work is based around informants and the "compensation" to them for that info.

You're basically saying an informant is really extorting the person they are giving up info about but I've never heard of an informant being civilly prosecuted for extortion.

Also, many jurisdictions have anonymous tip lines and if that info leads to a conviction the tipster is reward with money.

Are you saying the anonymous tipsters are exorting the people they are droppin dime on? Of course not, because an anonymous tipster has never been civilly convicted of turning in a person.

BTW, you of all people should also know it's against the law to have knowledge of a crime and not notify the police.

All my examples above cancel out your "extortion" notion.

You don't get an "opinion" over the actus reus of the crime of extortion Blue Dot.

You are either right, or you're wrong. In this case, you're wrong.

If you bothered to read the passage you actually quoted, you'd see it is the threat of procuring a criminal sanction over another in order to achieve a benefit or other gain which is the crime; it's not the actual ratting Blue Dot.

Oh? Please - educate us all on the harsh criminal sanctions we all face for not reporting crimes that have already taken place.

Kindly leave out from those doubtless THOUSANDS of examples that you must be referring to, the failure to report child abuse while being in a position of trust or authority in relation to the abused child. Some jurisdictions (though far from all) have actually criminalized that failure.

That example aside, you'll find yourself left with a mighty short list of crimes that have already taken place that it is a CRIME not to report. Indeed, that number would be approaching ZERO.

But, I'm all ears to hear about this new legal duty upon us all to be a snitch.

Not sure why you caught so much flak for "not being form California"in those other threads. Pretty irrelevant.
As for Blue Dot, the guy's got a huge chip on his shoulder, not sure why, but oh well. The real problem is that he thinks he knows more than he actually does.
Anyways it's edibles time and then off to bed for me.......

Original Poster, Are you in an apratment or a house? Basically I am asking if you are a renter or an owner.

Is moving, say acorss town or something short, an option? My thinking is that if you moved, thus removing many of the identifying elements of a picture, many prosecutors would be unwilling to hassle the current resident of said residence in order to conduct an investigation.

If said mother of girlfriend keeps the shit up and continues to pursue this issue make sure her mental state is examined by your lawyer. Destroy her credibility as a witness. Especially if she is going to keep doing this in hopes of extorting you. Her calling you at work is just unacceptable, harassment.

You do realise the only way you'd ever PROVE that someone is threatening them for profit is if the defandant admits such and that would never happen.

I could threaten you and just act like I'm doing it in "good faith" as a "good samaritan". How would you prove I was doing it for gain?

No, because it could be true that someone could threaten someone without financial gain in mind.

Maybe they are just a vindictive crazy psycho b*tch = no gain involved other then a preverse pleasure but that wouldn't equal extortion.

Thanks for all the helpful replies everybody! Yeah, I know it sounds like an ex, haha, it's actually my current girlfriend's mom. The whole thing is a very complicated and bizarre situation that would take WAY too long to explain, but this crazy lady, who smokes a lot herself, and who has grown herself pretty recently, actually snuck into my house and took these pictures, apparently. I have no evidence other than her word that these pictures even exist, although I have no reason to doubt that they do, and knowing what she's capable of, I'm sure that they do.

But basically, she's recently decided that she hates me and that I'm the devil or something stupid like that, so periodically she'll call me up at work and start screaming at me and cussing me out and telling me how she has pictures and she's gonna "slap a felony on my ass". I haven't been that worried this whole time, because I figured I've got plausible deniability due to a couple of factors, but she's been making a lot more noise lately and getting a lot more unstable and I feel like I have to actually seriously consider what would happen if she did decide to go to the police.
It is difficult to envision her showing pics of mj plants to the police if she smokes herself, but she is crazy so who knows. It goes without saying that you want to avoid her at all costs; also don't start any grows until she is out of your life for good. I believe that in Ohio, you can legally record those nasty phone calls which you have been receiving, without telling her (please confirm!) to serve as evidence that she is an obscene caller with a personal grudge against you. Also you can file a complaint with the police about obscene/threatening calls from her, if she keeps doing it. Consequently the cops know that she is hostile and bothering you. This would tend to put the heat on her. And you might want to keep a camera of your own handy in case she pulls any more sneak attacks, to get her on film. As for those alleged mj photos, I wouldn't worry about them.

Well, you're gonna have to off her then. When there's a problem, you have to take care of it;) Get some plastic, a shovel, a bag of lime and a shit load of bleach!! Hahahahaha:)

Just thinking aloud here ; Perhaps you could start another grow. While thats growing, somehow obtain a large plastic bag from mother in law. One that she has touched. Fill it with leaf, maybe a couple hairs from her brush, maybe her ID, a receipt, marijuana warranty card filled out in her name... what have you... hide it in her car and turn her in.

As long as the OP has quit growing (as was suggested in the title of the original post) and has nothing in their house to prove otherwise, just one persons word against the others, I don't see why it wouldn't work. Clear out the abode, and make sure that if anyone does come snooping around, the only thing they will find is just a silk plant. If a prosecutorial horticulturer expert wants to test a silk plant on the tax-payers dime, thats Ohios' business.
